1) Changes to the Lake Major Watershed Protected Water Area Regulations:
As a follow up to the Ministerial Order issued in March 2010, Halifax Water wishes to inform the public of the following amendments to the Lake Major Protected Water Area Regulations:
The order amends the Regulations in Schedule “A” subsections 7(2), (5), and (6), by striking out “Administrator” and substituting “Water Utility.” Prior to the amendment, Nova Scotia Environment was responsible for issuing Forestry Approvals to Operate; Halifax Water is now responsible for issuing the approvals. Under the amended regulations the Lake Major Watershed Advisory Board is still required to review and provide feedback on the proposed forestry plan.
The portion of the Lake Major Watershed Protected Water Area that falls within the Salmon River Long Lake Wilderness Area, is exempt from the changes. All provincial wilderness areas are the responsibility of Nova Scotia Environment and are protected from commercial activities such as forestry. The changes are now included in the current Lake Major Watershed Protected Water Area Regulations.
2) Off Highways Vehicles Act Ministerial Order for Pockwock Protected Water Area:
In June of 2008, a Ministerial Order was issued to further restrict the use of Off-Highway Vehicles (OHV) inside the Pockwock Protected Water Area under subsection 12F of the Off-highway Vehicles Act, R.S.N.S. 1989, c. 323. The order is as follows:
No person shall operate an off-highway vehicle on or through the Pockwock Lake Watershed Protected Water Area as designated by N.S. Reg. 12/95, December, 21, 1994, without the written permission of the Commission. For the purpose of this Order “written permission” has the same meaning as provided for in clause 1A(1)(b) of the Off-Highway Vehicles General Regulations, N.S. Reg. 13/88. This Order does not apply to peace officers, as defined in the Off-Highway Vehicles Act, in the performance of their duties.
