RESOLVED by the Town Council of the Town of Bedford that the following by-law be and
the same is hereby enacted, and the Clerk is hereby instructed to forward four copies
thereof to the Minister of Municipal Affairs with a request for the Minister's approval thereof,
and that he also request the approval of the Minister of Transportation and Communications
on behalf of the Town.
CLOSING PUBLIC STREET
1. THAT the Council do close to public use a portion of the Old Hammonds Plains Road
between Doyle Street and the Bedford Highway.
2. THAT the portion of the street to be closed is described as follows:
ALL THAT parcel of land, being a portion of the Old Hammonds Plains Road lying
between the southerly end of Doyle Street and the westerly limit of the Bedford
Highway, designated as Parcel H-2 on a "Plan of Survey of Parcel H-3 and Block 1
being a Subdivision and Consolidation of Lots 1, 2-A, 32-B, 38 and 39 and Parcels
MP, H, H-1 and H-2, Lands of the Town of Bedford", prepared by Wallace
MacDonald & Lively, Ltd., signed by James C. Banks, N.S.L.S., and dated the 27th
day of September, 1991, said Parcel H-2 having an area of 35,934 square feet, more
or less, and being more particularly described as follows:
PREMISING that the line joining Nova Scotia Coordinate Monument 28292 to Nova
Scotia Coordinate Monument 28291 has a grid bearing of North 39043'30" West, and
relating all bearings herein thereto;
COMMENCING at a survey marker placed on the easterly limit of Doyle Street
where it is intersected by the northeasterly limit of the Old Hammonds Plains Road,
said point being on a curve having a radius of 333.00 feet, as shown on said plan;
THENCE along said curve to the right an arc distance of 49.80 feet, chord equivalent
being 49.76 feet, measured on a course South 51016'09" East to a point of reverse
curve, as shown on said plan;
THENCE on a curve to the left having a radius of 267.00 feet an arc distance of
138.89 feet, chord equivalent being 137.33 feet, measured on a course South
61053'10" East to a point of reverse curve, as shown on said plan;
THENCE on a curve to the right having a radius of 333.00 feet an arc distance of
127.51 feet, chord equivalent being 126.74 feet, measured on a course South
65049'05" East to a survey marker found at the southwest corner of Lot 1, Lands of
the Town of Bedford, as show on said plan;
THENCE South 64019'35" East along the southwesterly limit of said Lot 1, and
continuing along the southwesterly limit of Lot 2-A, a distance in all of 157.88 feet
to the northwest corner of Parcel H, a closed portion of the Old Hammonds Plains
Road, as shown on said plan;
THENCE South 04048'00" East along the westerly limit of said Parcel H a distance
of 76.58 feet to its intersection with the northeasterly limit of Parcel H-1, as shown
on said plan;
THENCE North 64019'35" West along the northeasterly limit of said Parcel H-1 a
distance of 202.48 feet to the beginning of a non-tangential curve having a radius of
267.00 feet, as shown on said plan;
THENCE along said curve to the left an arc distance of 107.41 feet, chord equivalent
being 106.69 feet, measured on a course North 65015'47" West to a point of reverse
curve, as shown on said plan;
THENCE on a curve to the right having a radius of 333.00 feet an arc distance of
173.22 feet, chord equivalent being 171.28 feet, measured on a course North
61053'10" West to a point of reverse curve, as shown on said plan;
THENCE on a curve to the left having a radius of 267.00 feet an arc distance of
182.56 feet, chord equivalent being 179.02 feet, measured on a course North
66034'20" West to a survey marker placed at the northeast corner of Parcel H-3, as
shown on said plan;
THENCE North 27038'42" East a distance of 0.72 feet to a survey marker;
THENCE North 89053'00" East along the southerly limit a portion of the Old
Hammonds Plains Road, and continuing along the southerly end of Doyle Street, a
distance in all of 170.90 feet to a survey marker placed at its intersection with the
easterly limit of Doyle Street, as shown on said plan;
THENCE North 06002'00" West along the easterly limit of Doyle Street a distance
of 7.26 feet to the point of commencement.
3. THAT the portion of the street above described be closed, and that all rights of public user
therein be forever extinguished, and that the Town may sell and convey the said lands.

Banks, N.S.L.S., said Parcel D being a portion of the Bedford Highway, Lands of the
Town of Bedford and containing an area of 1699 square feet, more or less, and being
more particularly described as follows:
PREMISING that the line joining Nova Scotia Coordinate Monument 69 to Nova
Scotia Coordinate Monument 68 has a grid bearing of North 13046'06" West, referred
to meridian 64030' West and relating all bearings herein thereto;
COMMENCING at a survey marker placed on the southwesterly limit of Canadian
Government Railways Lands at the most southerly corner of Parcel C, Lands of
Ultramar Canada Inc.;
THENCE along a curve having a radius of 1495.39 feet being the northeasterly limit
of Bedford Highway, an arc distance of 70.14 feet, chord equivalent being 70.13 feet
measured on a course North 54050'37" West to a survey marker placed on the
southeasterly limit of Lot A, Lands of Ultramar Canada Inc.;
THENCE South 41004'16" West along the southeasterly limit of Lot A, a distance of
13.11 feet to a survey marker;
THENCE South 33044'56" East, a distance of 11.00 feet to a survey marker placed
on a curve having a radius of 1471.39 feet;
THENCE along said curve to the right an arc distance of 70.65 feet, chord equivalent

2. THAT pursuant to instructions received by me from the Town
Council of the Town of Bedford I caused to be published Notice of
Intention of the Council to close to public use a portion of the street
commonly known as Bedford Highway.
3. THAT the Notice of Intention was inserted as an advertisement
in the Mail Star, a newspaper circulating in the Town of Bedford, on
the 26th day of August, 1991, and on the 3rd day of September, 1991,
the first of such notices being published at least three clear weeks
prior to the 17th day of September, 1991, the date fixed for the Town
Council to meet and hear those in favour and those opposed to the
closing of the portion of the said street.
4. THAT at the meeting of the Town Council duly called and held on
the 17th day of September, 1991, at 7:30 in afternoon, all those wishing
to speak were heard, and the proposed By-Law was then considered
and passed by the members of the Town Council present, all of whom
were also present at the hearing.
AND I MAKE this solemn declaration conscientiously believing it
to be true and knowing that it is of the same force and effect as if made
under oath by virtue of the Canada Evidence Act.
