BE IT RESOLVED that the following be and the same is hereby adopted and enacted
as a By-law of Halifax County Municipality when and if the same has received the
approval of the Minister of Municipal Affairs, and that the Municipal Clerk be and he
is hereby instructed to forward the same to the Minister and request his approval
hereof.

BY-LAW NO. 28
A BY-LAW RESPECTING SPECIAL SEWER TAXES
Title
1. This By-Law shall be known as and may be cited as the "1977 Special Sewer
Taxes By-Law."
Definitions
2. In this By-Law unless the context otherwise
indicates:
(a) "combined sewer service" means the service that includes both a sanitary
sewer and either a storm sewer or a storm drain vested in or under the control
of the Municipality;
(b) "sanitary sewer" means a sewer receiving and carrying water born wastes
from residences, business buildings, institutions and industrial
establishments, and to which storm, surface or ground wastes are not
intentionally admitted;
(c) "sewer" means a pipe or conduit for carrying sewage, storm water or surface
runoff or sewage and storm water and surface runoff, and includes all sewer
drains, storm sewers or storm drains and combined sewer services of every
description vested in or under the control of the Municipality.
3. Where prior to the effective date of this By-Law no special tax has been levied
in respect of a public sanitary sewer, the special tax levied under the
provisions of subsection (1) of Section 46 of Chapter 87 of the Acts of 1962,
as amended by Section 2 of Chapter 111 of the Acts of 1973, is hereby fixed
and determined at 15.00 Dollars, for each lineal foot of real property on the
street in which the public sanitary sewer is built or has been built, in
Bedford-Sackville and 12.95 Dollars for each lineal foot of real property on the
street in which the public sanitary sewer is built or has been built in Cole
Harbour - Westphal - Eastern Passage.
.4. The special tax levied under the provisions of subsection (1) of Section 46A
of Chapter 87 of the Acts of Nova Scotia, 1962, as amended by Section 4 of
Chapter 11 of the Acts of 1973, is hereby fixed and determined at 23.85
Dollars for each lineal foot of real property on the street in which the
combined sewer service is built or has been built in Bedford-Sackville and
22.95 Dollars for each lineal foot of real property on the street in which the
combined sewer service is built or has been built in Cole Harbour - Westphal -
Eastern Passage.
5. Where prior to the effective date of this By-Law no special tax has been levied
in respect of a public sanitary sewer, the special tax levied under the
provisions of subsection (1) of Section 47 of Chapter 87 of the Acts of Nova
Scotia 1962, as amended by Section 7 of Chapter 111 of the Acts of 1973, is
hereby fixed and determined at 15.00 Dollars, for each lineal foot of real
property fronting on the street in Bedford-Sackville and 12.95 Dollars for
each lineal foot of real property fronting on the street in Cole Harbour -
Westphal - Eastern Passage. (Amended November 15, 1977, Approved
December 1, 1977).
6. The special tax levied under the provisions of subsection (1) of Section 47A
of said Chapter 87 as amended by Section 7 of Chapter 111 of the Acts of 1973,
is hereby fixed and determined at 23.85 Dollars for each lineal foot of real
property fronting on the street in Bedford - Sackville and 22.95 dollars for
each lineal foot of real property fronting on the street in Cole Harbour -
Westphal - Eastern Passage. (Amended November 15, 1977, Approved
December 1, 1977).
7. The rate of interest chargeable on the entire amount from time to time
outstanding of any special taxes levied under this By-Law from the date on
which the entire amount first becomes due has been paid is fixed at eleven
percent per annum.
THIS IS TO CERTIFY that the By-law of which the
annexed is a true copy was duly passed at a duly called
meeting of the Municipal Council of Halifax County
Municipality duly held on the 15th day of November, A.D.
