BY-LAW A-501

Being a by-law of the City of Dartmouth with respect licensing of persons maintaining automatic machines, game tables, vending machines and mechanical rides. .

The Council of the City of Dartmouth enacts as follows:

1. In this by-law: (a) "automatic machine" means any pinboard, pinball or any automatic or slot machine (so called) which is operated by the introduction of money or counter but does not include automatic scales, telephone apparatus or electric meters, nor those things the use or keeping thereof is prohibited by law for the reason that they constitute a gambling device, or for any other reasons;

(b) "game table" means a device that allows the playing of a game upon the deposit of money or counter but does not include automatic machines or juke boxes as herein defined;
(c) "jukebox" means and includes that type of automatic machine which or by means of which music, speech or similar entertainment is produced but does not include individual wall boxes (so called);

(d) "maintain" includes own, maintain, control or have in one's custody or possession or on one's premises for operation by other persons;

(e) "mechanical ride" means any stationary apparatus designed to carry and move persons for their enjoyment; (f) "person" means any person, male or female and includes body corporate or a partnership;

(g) "residential zone" includes the following use zones as defined by the Dartmouth Zoning by-law, namely; R-1, R-2, R-3, R-4, R-5, R-6, R-7, R-8, R-9, R-10, R-11 and R-12; (h) "vending machine" means a machine or device that releases goods, wares, food, drink or merchandise upon the deposit of money and includes a bulk vending machine which dispenses unpackaged items in bulk.

14. Not more than two automatic machines or two game tables or one of each of these shall be licensed to be maintained in the same premises located in a residential zone and no person shall maintain more that two such automatic machines or game tables in the same premises in such residential zone.

14.A. Any person who contravenes or fails to comply with any provision of this by-law shall be liable on conviction to a fine not exceeding Two Thousand Dollars ($2,000.00) and in default of payment to imprisonment for a period not exceeding sixty (60) days.

15. By-law A-500 of the City of Dartmouth is hereby repealed.
