BY-LAW P-300
Being a by-law of the City of Dartmouth with respect to
penalties for violation of City by-laws.
The Council of the City of Dartmouth enacts as follows:
1. Any person who violates any by-law of the City shall,
unless a penalty is otherwise specifically provided in such
by-law, be liable on conviction for every such offence to a
penalty not exceeding Two Thousand Dollars ($2,000.00) and costs,
and in default of payment to imprisonment for a period not
exceeding 60 days.
2. Where the conviction is for non-payment of any licence
fee payable to the City under the provisions of any by-law, the
magistrate or judge may order payment thereof in addition to the
penalty.
3. (1) Any person who violates any of the by-laws listed
in Schedule "A" to this by-law may voluntarily pay
a penalty in lieu of being prosecuted for the
offence, upon being given notice in writing by:
(a) a special constable in the case of the Dog
By-law; and
(b) the City Clerk, a Police Officer, or a Special
Constable, in any other case.
(2) Where a voluntary penalty is paid, the amount
thereof shall be that stated in Schedule "A" for
the by-law violated.
(3) The voluntary penalty may be paid to the City
Clerk-Treasurer.
(4) Where a person pays a voluntary penalty pursuant to
this section, he shall be deemed to be convicted of
the offence in respect of which the voluntary
penalty is paid.
4. By-law C-677, as amended, is hereby repealed.
5. Notwithstanding section 1, this by-law shall not apply to
violations of by-law P-200 respecting parking meters.
