Application - Information Summary

Application by W.M. Fares Group on behalf of Basin Vista Developments Limited to amend the Halifax Municipal Planning Strategy (MPS) and Halifax Mainland Land Use By-law (LUB) to permit a mixed use building by development agreement.

Proposal

The developer has proposed a mixed use building containing 150 residential units and 104 office units or hotel suites in a single building complete with 3 storeys of enclosed parking and a penthouse. The 19 storey residential tower sits on a 3 storey podium containing the hotel/office use.

Process

The application is being considered under the Municipal Planning Strategy amendment and development agreement process.

Status

A staff report dated February 4, 2010 was presented to Regional Council and Chebucto Community Council (CCC) at a joint public hearing held on April 20, 2010.  After the public hearing was closed, Regional Council approved the proposed amendments to the Halifax MPS and the Halifax Mainland LUB. The amendments have been reviewed by the Provincial Director of Planning, and came into effect on May 31, 2010.


The proposed development agreement was approved by CCC on June 7, 2010.
  The decision may be appealed to the Nova Scotia Utility and Review Board for a period of two weeks following publication of the notice of approval in the newspaper.  The appeal period expired on June 26, 2010.

Documents Submitted for Evaluation

The applicant has submitted revised plans and studies required by HRM staff to properly evaluate the application.  These materials also are available for review at the Planning Services office in Halifax.
