Halifax Peninsula Land Use By-law Amendments

Application

Application by HRM to consider amending the Halifax Peninsula Land Use By-law to permit backyard laying hens (chickens).

Proposal
On December 14, 2009, Peninsula Community Council (PCC) passed a motion that

"staff open a planning application to consult with the public, address any potential issues (e.g. separation distances, number of hens, prohibition of roosters) and, if appropriate, draft amendments to the Halifax Peninsula Land Use By-law to permit backyard laying hens."

The Halifax Peninsula Land Use By-law (Peninsula LUB) applies to the area shown on this map.  At this time, only amendments to the Peninsula LUB are being considered; existing regulations will continue to apply in other communities (e.g. Halifax Mainland, Dartmouth).

Process
The application is being considered under the LUB amendment process.

Status
A public information meeting was held on Wednesday, February 10, 2010 at Halifax Hall.  Staff gave a presentation, and received feedback from the public.  A handout and a map of lot sizes were also available.  As part of the public consultation for this case, staff also prepared a survey, which was distributed at the public information meeting and was also available online. Minutes from the information meeting and results from the survey will be included with the staff report.

The proposal will undergo a detailed review.  Staff will prepare a report to be tabled at PCC.  If PCC decides to consider the Land Use By-law amendments, they will schedule a public hearing.  Notice of a public hearing will be published in the newspaper and on the HRM website, as well as mailed to those people who signed up at the public information meeting.
