Proposal
Regional Council, at its September 21, 2010 meeting, initiated a process to consider amendments to the Municipal Planning Strategy (MPS) and Land Use Bylaw (LUB) for Planning Districts 1 and 3 (St Margaret’s Bay) Plan Area to incorporate the recommendations of Community Forum III, “Vision to Reality”, a concept plan for Upper Tantallon at the Crossroads.
The community was concerned about development occurring in the community and responded to these develop pressures by organizing 3 annual community forums. They felt the need to map out a strategy for how Upper Tantallon at the Crossroads was to retain and enhance its character as a traditional coastal village. The results of the first two Community Forums, and in particular the Community Forum III, held in the spring of 2010, formed the framework for the proposed amendments to the MPS and LUB.
Municipal Planning Strategy
There are number of MPS land use designations present in the study area, including:
- Mixed Use A (MUA)
- Mixed Use B (MUB),
- Hubley Mill Lake (HML)
- Mixed Rural Residential (MRR)
- Residential (RES)
The most prevalent designation is MUB. These designations allow for a hierarchy of land uses that transcend from primarily residential uses in the Residential designation to that of the Mixed Use designations which allow for a wide array of uses including residential, commercial and industrial.
Zoning
Current zoning in the area ranges from Residential (RA) and General Residential (RA-1) Zones which are predominantly residential land uses, to Mixed Rural Residential (RR-1), which allows for residential, commercial and agricultural, forestry and fishery uses to Mixed Use (MU-1 and MU-2) Zones, which is are very permissive zones that allow for a wide array of residential, commercial and industrial uses. In order to allow the appropriate mix of land uses, Staff have been working with the community to draft new Land Use By-Law provisions:

Staff have also been working towards producing new MPS policy. New MPS policy is necessary to support the idea of three new zones. New MPS policy is also necessary to ensure certain uses are evaluated through a public process.

The proposed amendments would limit the types of uses in the village centre area to commercial uses with the opportunity for mixed use developments, residential, commercial and certain industrial uses in the gateway areas and restrict development to largely residential uses in the residential areas.

Public Consultation
Staff are seeking comment about the proposed zoning and policy changes in the community. A public information meeting was held Thursday, June 2, 2011 at the Bay Road Community Hall, Lewis Lake.
