Application by Banc Properties Limited to re-designate a portion of the lands at 31 and 33 Brewer Court, Halifax and enter into a development agreement to allow a 6-unit townhouse development and a semi-detached dwelling.

The subject lands are located at 31 ad 33 Brewer Court in Halifax, located behind an existing apartment building. The properties are designated RDD (Residential Development District), MDR (Medium Density Residential) and LDR (Low Density Residential, under the Mainland South Secondary Planning Strategy under the Halifax Municipal Planning Strategy (MPS). The properties are zoned both R-2 (Two-Family Residential) and R-3 (General Residential and Low-Rise Apartment) under the Halifax Mainland Land Use By-law (LUB). The property is currently vacant, and is proposed to be developed with a 6-unit townhouse development and a semi-detached dwelling, both with access from Brewer Court.
The site plan (provided below) outlines the proposed lot boundary, the access, the parking, and the building footprint. This proposal may be considered under existing MPS policies for a portion of the site, however, the existing Generalized Future Land Use Map (GFLUM) boundary currently applies multiple designations to the subject site. Only one designation permits the proposal to be considered through the development agreement process. Therefore, the applicant is seeking amendments to the Halifax Mainland plan to enable the proposal.
This application is being considered through the Municipal Planning Strategy Amendment and Development Agreement process.

On March 21, 2017 Regional Council initiated the process to consider amendments to the Halifax MPS to alter the boundaries of the land use designation on the GFLUM in the area of Brewer Court, Halifax. Staff have undertaken a detailed review of this application, and in the process of preparing a draft development agreement and recommendation staff report. Regional Council and Halifax and West Community Council will jointly consider the MPS amendment and the proposed development agreement, and make a decision on the proposed MPS amendment. Notice of the public hearing will be published in the Municipal Notices section of the newspaper. In the event Regional Council approves the MPS amendments, the Halifax and West Community Council may the decide on the proposed development agreement subsequent to the MPS amendments coming into effect.
