The subject lands are located on Kelly Street in Halifax, behind an existing apartment building. The property currently has frontage on Brewer Court. The property is designated MDR (Medium Density Residential) under the Municipal Planning Strategy for Halifax (MPS), and is zoned both R-2 (Two-Family Residential) and R-3 (General Residential and Low-Rise Apartment) under the Land Use Bylaw for Halifax Mainland (LUB). The property is proposed to be developed with a 6 unit townhouse and will be required to be subdivided from its current frontage on Brewer Court and frontage and access are proposed to be provided on Kelly Street, adjacent to the existing apartment building. The property is currently vacant.
The site plan (provided below) outlines the proposed lot boundary changes, the access, the parking, and the building footprint. The details of the proposed development will be reviewed in accordance with the relevant policies of the MPS, resulting in a recommendation to Council. The two-unit dwelling proposed to front on Brewer Court is not proposed as part of the development agreement proposal, but will proceed under existing regulation, and does not require specific Council approval.
This application is being considered through the substantive amendment to a development agreement process.
Staff are currently initiating a detailed review of this application. Staff will forward a report providing a recommendation on whether Halifax and West Community Council should consider approving the proposed development agreement. Prior to any decision by the Community Council a public hearing will need to be held. Notice of the public hearing will be published in the Municipal Notices section of the newspaper.
