Studio Works International Ltd. is requesting to enter into a development agreement to permit a residential apartment building at 2267 Brunswick Street, Halifax.

The applicant’s proposal is to develop a 13 storey multiple unit residential addition to the rear of St. Patrick’s Rectory at 2267 Brunswick Street having 49 dwelling units and 7 underground parking spaces.
Following public consultation and a review by Halifax and West Planning Advisory Committee the proposal was changed to a 9 storey addition with 51 dwelling units and 8 parking spaces. This was the request before Halifax and West Community Council at the public hearing on November 14, 2018.
The motion for Community Council’s consideration after the closing of the public hearing was:
MOVED by Councillor Smith, seconded by Councillor Zurawski
That Halifax and West Community Council approve the proposed development agreement, which shall be substantially of the same form as set out in Attachment A of this report, conditional upon approval of a final plan of subdivision as required in the development agreement.
Community Council chose instead to exercise its right to defer a final decision on the motion above and the following motion was adopted:

THAT Halifax and West Community Council direct staff to consult with the developers to seek amendments to the proposed development agreement for Case 20417 to limit the height of the proposed development so that it does not exceed the roofline of St. Patrick’s Church, and return with a supplementary staff report outlining the terms of any amended development agreement.

Revised Proposal Details following the Public Hearing
The applicant has considered the motion from Community Council and have indicated they are agreeable to an amended proposal as follows:
• Building height was reduced from nine (9) floor levels to eight (8) floor levels;
• Dwelling units were reduced from 51 units to 42 units;
• Motor vehicle parking spaces were reduced from eight (8) to four (4);
• Subdivision of lands is not required to accommodate a proposed smaller building footprint (6792 square feet was reduced to 5964 square feet);
• Brick, similar in colour to the Rectory, is now proposed on the Brunswick Street and two interior lot elevations (east and west elevations);
• Stone masonry is now the proposed material for first and second floor level exterior;
• Light coloured cladding and aluminum curtain walls are proposed materials for third floor level to penthouse; and
• Protruding balconies removed from the elevation facing the Church (east elevation).
These materials are also available for review at the municipal Planning Services office in Dartmouth at 40 Alderney Drive, Dartmouth, 2nd Floor. You may also view the staff report and proposed development agreement from the November 14, 2018 public hearing.
This application is being considered under the development agreement process. The development agreement process will include public consultation and a public hearing.
A public information meeting was held on Wednesday, November 30, 2016 beginning at 7:00 p.m. at the Saint Josephs Alexander McKay Elementary School Gymnasium, 5389 Russel Street, Halifax.
On May 29, 2017 the application was before the Halifax Peninsula Planning Advisory Committee (PAC) that recommended that the application be rejected because the concept as presented was not acceptable and that the applicant explore an alternative design. The applicant has revised the proposal based on comments received from PAC.
On November 14, 2018 a public hearing was held by Halifax and West Community Council . A copy of the staff report before Council at that public meeting may be obtained by calling HRM Planning and Development at 902-490-4472. Alternatively, the staff report is available on-line.
After the public hearing closed Halifax and West Community Council directed staff to consult with the developers to amend the proposed development agreement for Case 20417 to limit the height of the proposed building so that it does not exceed the roofline of St. Patrick’s Church, which is an abutting Municipal Heritage Building, and return with a supplementary staff report outlining the terms of any amended development agreement. Approved minutes of the public hearing are also available.
The applicant has revised the proposal for the addition to the Rectory that is summarized in a revised proposal list above and revised drawings are linked below under the submitted documents. The requested supplementary report will be linked to the Halifax and West Community Council agenda when it is published on-line. A second public hearing will be held and information regarding the date and time will be provided on this site as well as in mailed notification
