Ms. Lorna Snair is applying to amend to the Musquodoboit Valley/Dutch Settlement Municipal Planning Strategy [MPS] and Land Use By-law [LUB] and the Halifax Regional Subdivision By-law to enable the subdivision of her lands into 6 lots in Meaghers Grant.
The applicant is seeking to amend the Musquodoboit Valley/Dutch Settlement MPS and LUB and the Regional Subdivision By-law to allow the creation of 6 lots with reduced or no road frontage on lands that lie north east of Highway #357 within proximity to Lays Lake Road [Maps 1 and 2 as follows] in Meaghers Grant.
The subject lands are located in the Village Designation of the Musquodoboit Valley/Dutch Settlement Municipal Planning Strategy [MPS]. The Village Designation does not permit the creation of more than two lots with reduced or no road frontage as an exemption under the Subdivision By-law. Under the Regional Subdivision By-law, the property cannot be subdivided into six lots without 60.9m [200 ft] of contiguous frontage on Highway 357 per lot or 30m [100 ft] of frontage per lot on a public road extending off of Highway 357. The property has 30m [100 ft] of frontage on the east side and 38 m [126 ft] on the west side on Highway 357.
The Applicant is requesting an amendment to the Musquodoboit Valley/Dutch Settlement Municipal Planning Strategy and the Regional Subdivision By-law in order to subdivide the parcel into six lots with reduced or no road frontage. The proposed lots would be accessed via a private driveway.
This application is being considered under the municipal planning strategy amendment and land use by-law amendment process and subdivision by-law amendment process.
On November 22, 2016 Regional Council initiated the Planning process following consideration of an initiation report presented by staff.
A public information meeting was held on Thursday February 23, 2017 beginning at 7:00 p.m. at the Meaghers Grant Community Hall, 4413 Highway 357, Meaghers Grant, N.S. BON 1V0.
A staff report with recommendations has been prepared and was presented to the North West Community Council on October 16, 2017. A copy of this report is available online.
The North West Community Council referred the report to Regional Council for a public hearing with a date to be determined.
