Application by Upland Planning and Design Studio for amendments to the existing development agreement for lands at Dutch Village Road and Supreme Court, Halifax (The Boss Plaza) to allow for a change of use of Buildings A and B from commercial to mixed-use (residential and commercial), increases in floor area of Buildings A, B and C, changes to the exterior appearance of all buildings and changes to the exterior fencing (landscaping) requirements for the proposed development.

The applicant wishes to amend the existing development agreement for the site. The major aspects of the proposal are as follows:
Proposed changes to the architectural design/ appearance of the entire development (Building portions A through E) to provide a more contemporary look, including some changes to exterior building materials.
Detailed breakdown of building changes for each “Building” (portion) of the development:
- Building A: Change from office & ground-floor retail to residential/ retail building; change from 6 commercial floors to 8 floors* (7 residential, 1 commercial); increase in building height by approximately 5 ft., 8 in. (from approximately 74 ft. to 79ft., 8 in.); Approximate # of dwelling units = 84; Approximate floor area = 100,000 sq. ft.; *(Note: commercial floor-to-floor heights are greater than residential floor heights, which explains the larger number of residential floors)
- Building B: Change from office & ground-floor retail to residential/ retail building; change from 3 commercial floors to 5 floors on smaller footprint (4 residential, 1 commercial); increase in building height by approximately 12 ft., 8 in. (from approximately 38 ft. to 50ft., 8 in.); Approximate # of dwelling units = 28; Approximate floor area = 45,000 sq. ft.;
- Building C: Increase in the allowable tower floor plate size from 13,500 to 15,000 square feet per floor. This would allow for slightly larger and reconfigured bedrooms. Increase in ground-floor commercial space, on the western end of the podium, by 8,600 square feet. Total floor area increase (Building C only): 19,100 sq. ft.;
- Building D & E: No additional changes, other than minor exterior architectural design changes noted above;
Underground Parking: Ability to have up to three partial underground parking levels, instead of two underground levels. This would not change the number of required parking spaces.
Landscaping: Proposed changes to the landscaping clause to eliminate the requirement for a wooden privacy fence along the rear property lines of dwellings on Ashdale Avenue and Rufus Avenue, due to the presence of natural vegetation which provides visual screening.
The application has been circulated internally to staff for review and comment. Public consultation includes notification by mail to adjacent property owners surrounding the site.
