The applicant purchased the subject property in 2013 and wishes to have a wider variety of commercial uses at the site including automotive repair, self-storage and office uses. The property is subject to a development agreement that permits the manufacturing of roof trusses and general building supplies and Highway Commercial (C-4) uses. The industrial business no longer operates at the site and the applicant does not want to permit new industrial uses at the site, which is consistent with the intent of the Cole Harbour / Westphal Municipal Planning Strategy (MPS).
There are six buildings on the property with a total floor area of 6,178 square metres (66,500 square feet). The property is currently occupied by several commercial uses and the applicant has indicated that highway commercial space in Cole Harbour / Westphal is in high demand.
The property is split zoned C-4 (Highway Commercial) and R-1 (Single Unit Dwelling) and split designated HC (Highway Commercial) and UR (Urban Residential). Due to the split designation, the options to use the property for commercial purposes are quite limited; however, commercial uses listed under the C-4 Zone are currently permitted on the entire site through the provisions of the existing development agreement.
Under the C-4 Zone, automotive repair is only permitted if there is a service station on the site. The applicant wishes to have auto repair without a service station. Properties designated HC can be considered for auto repair uses through the development agreement process. However, since the subject property is split designated, there is no policy to consider auto repair within the UR designated portion of the lot. Self-storage uses and offices are not permitted under the C-4 Zone and there is no policy to consider these uses. Therefore, the applicant is requesting an amendment to the MPS to allow for the adaptive reuse of the property for highway commercial uses.
Regional Council initiated the process at their meeting on August 15, 2017 following consideration of an initiation report presented by staff. Staff are completing a detailed review of the proposal.
