Application by Ekistics on behalf of Silver Sands Realty Ltd. to rezone a portion of PID 41453945 along Cow Bay Road from P-2 to RA to permit a single unit dwelling. Halifax Regional Municipality is considering expanding the area of rezoning to include the P-2 zoned portions of PIDs 41453937, 41459520 and 41459538 as well.
Proposal
The subject property is located in Cow Bay, 0.25 kilometres east of the intersection of Cow Bay Road and Autumn Drive. The property is designated SA (Special Area) under the Eastern Passage / Cow Bay Municipal Planning Strategy (MPS), and is zoned RA (Rural Area) and P-2 (Community Facility) under the Land Use By-law (LUB).
The half of the property abutting Cow Bay Rd is zoned RA. The half of the property abutting Cow Bay Lake is zoned P-2. The applicant wishes to rezone a portion of the P-2 zoned land to RA to allow for the development of a single unit dwelling in that location.
Halifax Regional Municipality is considering expanding the proposed area of rezoning to include the P-2 zoned portions of PIDs 41453937, 41459520 and 41459538 as well. These properties are located adjacent to the subject site and similarly zoned RA along Cow Bay Rd and P-2 along Cow Bay Lake.
Please note that the EC (Environmental Constraint) Zone located on PIDs 40293094 and 41459538 is not being considered under this rezoning and will remain unchanged. If approved, the rezoning will have no effect on Land Use By-law requirements as they relate to watercourse setbacks or wetlands.

Process
The application will be considered under the Rezoning Process.
Status
Staff are currently undertaking a detailed review of the application. Upon completion of the staff review a report will be submitted to the Harbour East - Marine Drive Community Council wish to consider the rezoning, a public hearing will be held. At the public hearing members of the public may address Community Council or submit written comments in advance. Anyone who received notification of the January 31, 2019 public meeting will also receive notice of the public hearing. Notice of the public hearing will also appear in the municipal notices section of the Chronicle Herald and on the municipal website.
A public information meeting was held on January 31, 2019 from 7:00 p.m. to 9:00 p.m. at the Eastern Passage Buffalo Club - 635 Cow Bay Road, Eastern Passage. A summary of the minutes can be found below.
Additional public consultation for this application has taken place in the form of a sign posted by the applicant on the subject site and a mailout with a direct request for input over an extended notification area.
Documents Submitted for Evaluation
The applicant has submitted plans and studies required by municipal staff to properly evaluate the application. Currently people will have to make an appointment with the planner to view the documents.
