Application by Gary Edwards and Garmar Investments Ltd. to amend an existing development agreement to allow for the subdivision and development of the remaining lands at 1490 Main Road, Eastern Passage.
The existing development agreement permits the development of two multi-unit buildings (totaling 120 units). The original planning application considered development of the remaining lands, however the agreement neglected to include any provisions to allow for the remaining lands to be developed. This amendment is to allow the remaining lands to be subdivided and developed in accordance with the Regional Subdivision By-law and Land Use By-law.
The properties are zoned C-2 (General Business) under the Eastern Passage/Cow Bay Land Use By-law (LUB) and is designated Community Commercial under the Eastern Passage/Cow Bay Municipal Planning Strategy (MPS). The proposal is being considered under Policy COM-12 of the Eastern Passage/Cow Bay MPS.
The application will be considered under the Substantive Amendment to Development Agreement process.
Staff are undertaking a detailed review of the application. A Public Information Meeting will be held on September 27, 2018.

The applicant has submitted plans and studies required by HRM staff to properly evaluate the application. The documents are also available for review at the Planning Applications office in Downtown Dartmouth.
