Innovative Architects, on behalf of Pioneer Management Ltd., has requested non-substantive amendments to the existing development agreement at 2287 Prospect Road (PID 40545626), Hatchet Lake to extend the date of commencement for construction by three-years.
The applicant has requested an amendment to an existing development agreement to extend the construction commencement deadline by three years under Section 6.2 of the Development Agreement. The existing development agreement requires construction to commence by November 20, 2018, which is three years after the development agreement was registered. This application proposes to extend the construction commencement deadline for another three years to November 20, 2021.
The applicant proposes to develop a 756 square metres (8,139 sq.ft.) addition to the existing physiotherapy clinic and for future commercial occupancies.
The existing Development Agreement (provided below) outlines the development proposal in detail, and includes information related to the proposed addition, parking location, driveway access and landscaping.
The application will be considered through the Non-Substantive Development Agreement Process.
A sign was posted by the applicant on the subject site advertising the intent to amend. Staff have reviewed of the application and will be sending a recommendation report to Halifax and West Community Council. The level of community engagement for the non-substantive amendment will involve information sharing through the municipal website, and signage posted on the subject site. A public information meeting and public hearing are not required for a non-substantive amendment to a development agreement. The decision on the amendments is made by resolution of Council.
