Denmar Real Estate Ltd. Has requested a non-substantive amendment to an existing development agreement at 8 Linden Lea in Dartmouth.
The applicant has requested an amendment to an existing development agreement to extend the construction commencement deadline by two (2) years under Section 6.1 of the Development Agreement. The existing development agreement requires construction to commence by January 27, 2019, which is two (2) years after the development agreement was registered. This application proposes to extend the construction commencement deadline for another two (2) years to January 27, 2021.
The existing Development Agreement (provided below) outlines the development in detail, and includes information related to the multiple unit building, parking location, driveway access and landscaping
The application will be considered through the Non-Substantive Development Agreement Process.
A sign will be posted by the applicant on the subject site advertising the intent to amend. Staff will undertake a review of the application prior to sending a recommendation report to Harbour East-Marine Drive Community Council. The level of community engagement for the non-substantive amendment will involve information sharing through the HRM website, and signage posted on the subject site. A public information meeting and public hearing are not required for a non-substantive amendment to a development agreement. The decision on the amendment is made by resolution of Council.
