On Thursday September 24, 2020 the Halifax and West Community Council (HWCC) held a public hearing to consider Case 22051. At this public hearing HWCC refused to enter into a development agreement to allow a service station at 1656 Prospect Road. The refusal decision of HWCC can be appealed by the applicant to the Nova Scotia Utility and Review Board.
Request
Revised Application (former Case 20750) by Sunrose Land Use Consulting, on behalf of Hatchet Lake Plaza Ltd., to enter into a development agreement for a Service Station with associate convenience store and drive-through restaurant at 1656 Prospect Road, Hatchet Lake.
Proposal
The property at 1656 Prospect Road, Hatchet Lake is 4 hectares (10 acres) in area. The development of the service station and associated convenience store and drive-through restaurant is not permitted as-of-right within the I-1 (Light Industry) Zone and therefore requires the discretionary approval of Community Council.
The site plan (see below under Documents Submitted for Evaluation) shows the revised proposal for the site.
The site plan shows a service station with 8 pump gas bar canopy and a 4,428 square foot building with associated convenience store and drive-through restaurant.
The subject property falls within the Planning District 4 (Prospect) Plan Area. The Municipal Planning Strategy for Planning District 4 (Prospect) enables Halifax and West Community Council to consider a development agreement on subject property under Policies RB-10 and IM-11.
Process
The application is being considered under the development agreement process.
Status
Public Consultation was held on February 27, 2019 @ 7pm at the Prospect Road Community Centre, 2141 Prospect Road, Hatchet Lake, Nova Scotia. The purpose of the consultation was to receive feedback regarding the proposal. Upon completion of the public consultation, staff will conduct an internal review of the application and submit a staff report to the Halifax and West Community Council to consider the proposed development agreement for the Service Station and to schedule a public hearing. Staff received an updated site plan in May 2020 and therefore proceeded with the final review.
On August 26, 2020 the Halifax and West Community Council (HWCC) made the decision to proceed with a public hearing. A public hearing was held on September 24, 2020. The public hearing format and a mailout was provided to residents with the notification area. At this public hearing HWCC refused to enter into a development agreement to allow a service station at 1656 Prospect Road. The HWCC decided to deny the proposed development based on the applicable policy criteria in the Planning District 5 Municipal Planning Strategy. The refusal decision of HWCC can be appealed by the applicant to the Nova Scotia Utility and Review Board.
