Application by Anne Guy requesting to rezone 24 Hester Street, Dartmouth from the R-1 (Single Family Residential) Zone to the R-2 (Two Family Residential) Zone of the Dartmouth Land Use By-law (LUB).
The current authorized use of the property is an non-conforming two-unit dwelling. The applicant has applied for a construction permit to construction additional dormers on the second floor, however, as per Section 256 of the HRM Charter, a non-conforming use cannot be expanded. The applicant has requested to rezone the property to reflect the existing use and allow for the additional dormers.
The properties are zoned R-1 (Single Family Residential) Zone under the Dartmouth Land Use By-law (LUB) and is designated Residential under the Dartmouth Municipal Planning Strategy (MPS). The proposal is being considered under Policy IP 1(c) of the Dartmouth MPS.
The application will be considered under the Rezoning process.
