A revised application was submitted by ZAPP Consultants on behalf of Shaw Group Ltd. (former application by Miller Developments Limited) for a development agreement for an Open Space Design Development (Conservation Design) at Cumberland Way, Carriage Road and Charleswood Drive, Windsor Junction.
A revised application for a residential development has been received for a 54 hectare (134 acres) site in Windsor Junction. This revised application proposes an Open Space Design development with a total of 176 residential units (92 single unit dwellings and 84 townhouses) serviced with Municipal water and on-site cluster styled sewage treatment.

In 2014, amendments were made to the Open Space Design (now known as Conservation Design Development) policies in the Regional Plan. This application was received prior to the 2014 Regional Plan amendments and will therefore be reviewed under the 2006 Regional Plan policies for Open Space Design.
On June 22, 2020 the North West Community Council (NWCC) made the decision to proceed with a public hearing. A virtual public hearing will be held on Monday, November 9, 2020 at 7:00 p.m. A mailout has been sent to residents within the notification area.
All oral and written submissions will be considered at that time. This meeting will occur in a virtual setting, and attending in person is not possible. Given the ongoing COVID-19 pandemic, written submissions are welcomed and encouraged in advanced of the hearing itself. These submissions are distributed to all Councillors and considered at the time of their decision. Written submissions may be forwarded to the Municipal Clerk by e-mail, by fax, 902-490-4208; or by mail, P.O. Box 1749, Halifax, Nova Scotia, B3J 3A5. Written submissions must be received by the Municipal Clerk’s office as early as possible and not later than 3:00 p.m. on November 9, 2020. Please allow sufficient time for delivery given slower than typical mail delivery times during the COVID-19 Pandemic.
The virtual public hearing will be webcast and may be viewed online. For individuals seeking to speak at the hearing, members of the public may contact the Municipal Clerk’s office no later than 4:30 p.m. on November 6, 2020 to be added to the speakers list to speak by telephone. We encourage all residents who have any desire to speak at the meeting to ask to have their name added to the list. Individuals who do not want to speak at a later time may ask to have their name removed from the speakers list.

A public open house was held on March 27, 2019 from 7:00 - 9:00 pm at the Gordon R. Snow Community Centre. The purpose of this open house was to update residents on the revised application based on resident feedback and current housing market preferences.
A public information meeting (PIM) was also held in October 2013, at Ash Lee Jefferson Elementary School, Fall River, to identify that the municipality has received an application, share information on the proposal and receive feedback on the proposal.
Following the public meeting, the updated proposal was reviewed by staff. As a final step a staff report and draft development agreement was prepared and forwarded to North West Community Council. The summary of minutes from both of the public information meetings will be included in the staff report. A public hearing is required prior to a Council decision on the matter.
An updated phosphorous assessment study was submitted by the applicant in January 2020. The staff report and proposed development agreement is currently under review. Once reviewed, the planning application will proceed to Community Council.
The NWCC will decide whether to approve or deny the proposed development based on the applicable policy criteria in the Planning District 17 and 17 Municipal Planning Strategy.
