Application by Mr. Charles on behalf of Mr. Dalrymple to enter into a development agreement to continue the existing business and comply with the current regulations for a salvage yard operation.
Proposal
The subject property is located in Clam Harbour, at 4442 Clam Harbour Bay Road. The property ( PIDs: 00560938 & 00603761) is designated MU (Mix Use) in the Eastern Shore West Municipal Planning Strategy and zoned MU ( mix Use) in the Land Use By-law.
The applicant wishes to continue the existing salvage yard operation and automotive repairs by complying with current regulations. The automotive repair, storage of oils, will continue to operate from the garage, and the storing, crushing of the salvage yard will operate in the area behind his home.
The major aspects of the proposal are as follows:
• Salvage yard operation of crushing and storage of vehicles;
• Minor automotive repair and storage of oils in garage
The existing salvage yard has been in operation since prior to the adoption of the Eastern shore West Land Use By-law and is currently a non-conforming use defined in the HRM Charter. The operation of the business is permitted by development agreement only.
The Development Plans outline the development proposal in detail, and include information related to a site plan for storage and crushing of vehicles, buffering and screening from the intermittent stream and Clam Harbour Bay Road.
Process
The application will be considered under the Development Agreement Process.
Status
The application is in the preliminary stage of review by planning and development staff. The team review is completed. A public information meeting took place on October 16, 2019 at 7:00 p.m. at the Ship Harbour Community Centre (214 West Ship Harbour Road). The engagement event in the community gathered input regarding the proposal. Adjacent property owners were notified of public consultation and a sign has been posted by the applicant on the subject site advertising the intent to enter into a development agreement. Staff are waiting for a revised site plan.
