ZZap Consulting Inc. has requested to discharge an existing development agreement at 5656 Spring Garden Road, Halifax.
The applicant has asked to discharge an existing development agreement and amending development agreement at 5656 Spring Garden Road. The development agreement was recorded at the Registry of Deeds on January 27, 1989 and the amending development agreement recorded on June 14, 1991 on the subject lands.
The major components of the existing agreement and amendment are as follows:
• allow a residential and commercial mixed-use development;
• allow no more than 85 dwelling units;
• provide 316 parking spaces;
• allow additional mixed-use condo units mid-block along Brenton Street; and permit commercial uses in all but 12 units along Brenton Street, Clyde Street and Dresden Row.
If the existing development agreement is discharged by Halifax and West Community Council, as requested, development on the subject lands will be controlled by the DH-1 (Downtown Halifax 1) Zone standards in the Downtown Halifax Land Use By-law (LUB).
The application will be considered under the Discharging Development Agreement Process.
Staff are undertaking a review of the application.
Halifax and West Community Council will not hold a public hearing in relation to this application: the existing development agreement may be discharged by resolution.
