Application by Fathom Studio, on behalf of property owner Tony Maskine/ Blue Basin Investments, requesting minor amendments to the building height provisions of the Halifax Mainland Land Use By-law to allow for an 8-storey mixed-use development on lands at Joseph Howe Drive (Property ID 41317306 and 41317744), Civic 3575 - 3587 Percy Street, and PID 40757429 Percy Street, Halifax. The subject site is located on the west side of Joseph Howe Drive, across from the Atlantic Superstore. The site has street frontage on both Joseph Howe Drive and Percy Street.
The proposal is to amend section 38BE(3) of the Halifax Mainland LUB, which deals only with those properties which have street frontage on both Joseph Howe Drive and Percy Street. The proposed amendments would allow changes to the method of calculating building height, as follows:
- Height measurement to be calculated from the “streetline grade” of Joseph Howe Drive instead of the average grade adjoining the building; and
- Height measurement to exclude rooftop architectural features, landscape elements and non-habitable penthouses which may include residential amenity space and which do not exceed 30 percent of the area of the roof on which it is located. This would be consistent with similar height exemptions in the Downtown Halifax MPS and Centre Plan areas.
The application will be considered under the Land Use By-law Amendment process.
A virtual public hearing will be held on Tuesday, August 11, 2020 at 6:00 p.m. All oral and written submissions will be considered at that time. This meeting will occur in a virtual setting and attending in person is not possible. Given the ongoing COVID-19 pandemic, written submissions are welcomed and encouraged in advanced of the hearing itself. These submissions are distributed to all Councillors and considered at the time of their decision. The staff report for this application is on the agenda of a special teleconference meeting of the Halifax and West Community Council on Wednesday, June 17, 2020 at 2:00 p.m. If Council gives First Reading to the application, then a date for and notification of a public hearing will be arranged in the future.
