A virtual public hearing was held by Halifax and West Community Council on Tuesday, January 19, 2021. The proposed Land Use By-law amendment was approved.
Any aggrieved person, the Provincial Director of Planning, or the Council of any adjoining municipality may, within fourteen days of the publishing of the official notice in the Chronicle Herald, appeal to the Nova Scotia Utility and Review Board (902-424-4448) in accordance with the provisions of the Halifax Regional Municipality Charter.
The appeal period for this matter ends on February 6, 2021.
Request
Application by Lloyd Robbins, on behalf of the property owner, requesting to rezone lands at 207 and 209 Greenhead Road, Lakeside to allow for an existing commercial garage.
Proposal
207 & 209 Greenhead Road are designated UR (Urban Residential) under the Timberlea/Lakeside/Beechville Municipal Planning Strategy (MPS). 207 Greenhead Road is partially zoned P-2 (Community Facility) and partially zoned R-3 (Mobile Dwelling). 209 Greenhead Road is zoned R-3.
At 209 Greenhead Road there is a commercial garage. The R-3 zone does not permit commercial garages. The commercial garage existed before the community plan came into effect, therefore, the commercial garage in its original form is permitted. However, two additions have been built onto the garage. The applicant is requesting to rezone the lands to C-3 (Service Business) and to have the garage added to the list of existing commercial uses to be able to apply for a permit to legalize the expansion of the garage.
The application is being considered under Policy UR-20 of the MPS, which allows for the continued use of existing service commercial uses through the application of the C-3 zone.
The site plan (provided below) shows the buildings and driveway accesses to the lots as they exist today.

The application will be considered under the Land Use By-law Amendment process.

A mailout was provided to surrounding property owners in June 2020 inviting them to provide feedback about the proposal.
