On November 8, 2021, the North West Community Council refused the application to amend the development agreement. Council’s refusal has been appealed by the applicant to the Nova Scotia Utility and Review Board.

Request

Application by WM Fares Architects, on behalf of Sunset Plaza Inc., requesting substantive amendments to an existing development agreement for lands at the corner of Swindon Drive and Hanwell Drive (PID 41292822), Middle Sackville to convert the land use from commercial to a 4-storey residential building with ground-floor commercial space.

Proposal

The subject site has street frontage along Swindon Drive and Hanwell Drive and backs onto Margeson Drive (Zoning Map). The site is currently vacant. The existing development agreement for Sunset Ridge allocates the site for commercial development, including the following uses: retail and food stores, services/ personal services, offices, banks and financial institutions, restaurants, and commercial schools. 

*The proposal is to amend the Development Agreement to allow for a 4-storey residential apartment building containing:

  • approximately 52 dwelling units; 
  • approx. 2,800 sq. ft. ground-floor commercial space;
  • indoor and outdoor parking spaces totaling 62 spaces;
  • indoor/ outdoor amenity spaces for residents (approx. 14,000 square feet); and
  • one driveway off Hanwell Drive.  

Process

The application will be considered under the Substantive Amendment to Development Agreement process.

Status

A virtual public hearing was held by North West Community Council on Monday, November 8, 2021 at 6:00 p.m.  View the staff report. At that time, the North West Community Council refused the application to amend the development agreement. Council’s refusal has been appealed by the applicant to the Nova Scotia Utility and Review Board.

The revised proposal was considered by the North West Community Council at a virtual meeting held on Wednesday, December 2, 2020.

Information letters were mailed to neighbouring residents and property owners in June 2020, seeking feedback on the proposal. 

Documents Submitted for Evaluation

The applicant has submitted plans and studies required by municipal staff to properly evaluate the application.
