IMPORTANT NOTICE – June 22, 2022


TAKE NOTICE THAT North West Community Council did, on Monday, June 20, 2022 approve the following application:

23556 - Request by North West Community Council for a staff report that considers amendments to the Sackville Drive Land Use Bylaw to allow access to multi-unit dwellings across LS zoned lots.

Any aggrieved person, the Provincial Director of Planning, or the Council of any adjoining municipality may, within fourteen days of the publishing of this notice, appeal to the Nova Scotia Utility and Review Board (902-424-4448) in accordance with the provisions of the Halifax Regional Municipality Charter.


This is a municipally-initiated project directing staff to consider amendments for the Sackville Drive Land Use By-law (LUB) to allow access to new multi-unit dwellings across LS (Large Scale Commercial) Zone lots.


This request for a staff report derives from lands on the Beaver Bank Connector and Sackville Drive (PIDs 40092777 and 40092769) which are zoned LS (Large Scale Commercial) and DC-3 (Downsview Complex-3).  The LUB allows access via the LS Zone to the DC-3 Zone for existing multi-unit dwellings but not for new multi-unit dwellings. The result is that a new development on the zoned DC-3 land can be entered via the Beaver Bank Connector but there is no ability to leave the property across the LS Zone lands.


The application will be considered under the Land Use By-law Amendment process.


Public consultation on the application was held over the month of November 2021. The next stage in the planning process is for this application to be considered by the North West Planning Advisory Committee at a virtual meeting held on March 2, 2022.   

A staff report was considered by North West Community Council on Monday, October 4, 2021, at a virtual Community Council meeting. NWCC approved the recommended motion and staff have begun the planning process to consider amendments to the Sackville Drive Land Use By-law.

A virtual public hearing was held on June 20, 2022 at 6:00 p.m.  All oral and written submissions will be considered at that time. This meeting will occur in a virtual setting and attending in person is not possible. Given the ongoing COVID-19 pandemic, written submissions are welcomed and encouraged in advanced of the hearing itself. These submissions are distributed to all Councillors and considered at the time of their decision.

Written submissions must be received by the Municipal Clerk’s office as early as possible and not later than 3:00 p.m. on June 20, 2022. Please allow sufficient time for delivery given slower than typical mail delivery times during the COVID-19 Pandemic. 

The virtual public hearing will be webcasted and may be viewed online at For individuals seeking to speak at the hearing, members of the public may contact the Municipal Clerk’s office no later than 4:30pm on June 17, 2022 to be added to the speakers list to speak by telephone.  We encourage all residents who have any desire to speak at the meeting to ask to have their name added to the list. Individuals who do not want to speak at a later time may ask to have their name removed from the speakers list.
