Request
Application by Stephen Adams Consulting Services Inc. to enter into a development agreement to allow for an expansion of a non-conforming commercial use at 749 Herring Cove Road, Halifax.
Proposal
The applicant wishes to be permitted to expand the existing building at 749 Herring Cove Rd, Halifax which is occupied by a sign company, New Century Signs. The major aspects of the proposal are as follows:
- This property currently has residential (R-2) zoning under the Halifax Mainland Land Use Bylaw. The existing commercial use was legally occupied before the current zoning requirements were applied and so it is considered a legal non-conforming use (“grandfathered”). Non-conforming circumstances are protected by the HRM Charter however expansion of the use can only be considered through the development agreement process.
- A development agreement is a legal agreement between a property owner and the Municipality to ensure a site is developed in a particular manner.
- The existing building footprint is 7,500 square feet. The proposal is to permit two additions to the building with a combined area of 9,840 square feet.
- The application proposes to maintain the current maximum height of the building.
The Development Plans (provided below) outline the development proposal in detail, and include information related to the proposed building additions design and location, site design, parking, and landscaping.

The application will be considered under the process for development agreements.
Status
A public hearing will be held by Halifax and West Community Council on Tuesday December 5th, 2023 at 6:00 p.m. at Halifax City Hall (Council Chamber), 1841 Argyle Street, Halifax, NS.
All oral and written submissions will be considered at that time. Written submissions are welcomed and encouraged in advance of the hearing itself. These submissions are distributed to all Councillors and considered at the time of their decision. Written submissions may be forwarded to the Municipal Clerk by e-mail; by fax, 902-490-4208; or by mail, P.O. Box 1749, Halifax, NS, B3J 3A5. Written submissions must be received by the Municipal Clerk’s Office as early as possible and not later than 3:00 p.m. on December 5th, 2023. Please allow sufficient time for delivery.
