On March 27th, 2023, Halifax and West Community Council approved the amendments to the Halifax Mainland Land Use By-Law to restore the ability to develop R-2 uses on certain US zoned properties in the Kearney Lake Area of Halifax.
Request
The municipality initiated housekeeping amendments to clarify the zoning permissions for properties zoned US (Urban Settlement) Zone in the Kearney Lake area of Halifax (Bedford West - Sub Area 11).
Proposal
During the public engagement conducted for Bedford West Sub Area 10 (Case 20401) planning staff were alerted to an inconsistency in the Halifax Mainland Land Use By-law (LUB) that occurred in 2006 when properties in Bedford West Sub Area 11 were re-zoned from the R-2 (Two Family Dwelling) Zone to the US (Urban Settlement) Zone.
It was intended that certain R-2 zoning permissions would be preserved, however this intention was not properly implemented. A section in the US Zone (Section 61A(5)) relies on a reference to “the area of Kearney Lake west of the Bicentennial Highway and designated Residential Environments”. “Residential Environments” is a designation displayed on the Halifax Municipal Planning Strategy Generalized Future Land Use map (GFLUM: Map 9). With the adoption of the Bedford West Secondary Planning Strategy (as a secondary strategy to the Halifax Municipal Planning Strategy (MPS)) the subject lands were re-designated as BWSPS and the reference in the Land Use By-law was not updated to reflect this.
This Planning Case was initiated to correct this reference error.

The application will be considered under the Land Use By-law Amendment process.

TAKE NOTICE THAT Halifax and West Community Council did, on March 27th, 2023, approve the amendments to the Halifax Mainland Land Use By-Law to restore the ability to develop R-2 uses on certain US zoned properties in the Kearney Lake Area of Halifax.
Any aggrieved person, the Provincial Director of Planning, or the Council of any adjoining municipality may, within fourteen days of the publishing of this notice on the HRM website, appeal to the Nova Scotia Utility and Review Board (902.424.4448), in accordance with the provisions of the Halifax Regional Municipality Charter.
This notice was posted to this site on March 29, 2023 in accordance with the requirements of the Halifax Regional Municipality Charter.
