NOTICE OF APPROVAL: TAKE NOTICE THAT as per Section 245 of the Halifax Regional Municipality Charter, a Development Officer of Halifax Regional Municipality did, on December 21, 2022, approve the Amending Development Agreement to extend the Commencement of Development and Completion of Development time periods required by the Original Agreement by three additional years.
Any aggrieved person, the Provincial Director of Planning, or the Council of any adjoining municipality may, within fourteen days of the publishing of this notice on the HRM website, appeal to the Nova Scotia Utility and Review Board (902.424.4448), in accordance with the provisions of the Halifax Regional Municipality Charter.

Request
Application by WM Fares Architects to change a previously approved development agreement applied to 440-526 Washmill Lake Drive, Halifax to allow more time for construction to begin and finish on the lands.
Proposal
The applicant wishes to extend the time in which development must commence and be complete by under an existing development agreement. The previously approved development agreement was entered in November of 2018 and permits a mixed-use subdivision development consisting of:
• residential uses inclusive of townhouses and multiple-unit buildings (total of 1,216 units), comprised of a maximum of 15 multiple-unit buildings and 60 townhouses to be developed in 9 phases;
• commercial uses throughout the development such as retail, restaurant, drinking establishment, office, personal service and others; and
• street connectivity between Regency Drive and Washmill Lake Drive.
The request for a time extension is considered a non-substantive amendment. No other changes are proposed to the original agreement.
Process
The application will be considered under the Non-Substantive Amendment to Development Agreement process.
Status
This application was approved by a Development Officer on December 21, 2022 and is within an appeal period. The Staff Report can be found here.
