NOTICE OF APPROVAL

TAKE NOTICE THAT a Development Officer of Halifax Regional Municipality did, on Wednesday, November 23, 2022, approve the Amending Development Agreement to allow a four (4) year extension to the date of commencement.

Any aggrieved person, the Provincial Director of Planning, or the Council of any adjoining municipality may, within fourteen days of the publishing of this notice on the municipal website, appeal to the Nova Scotia Utility and Review Board (902.424.4448), in accordance with the provisions of the Halifax Regional Municipality Charter.

Request

Omar Gandhi Architect Inc., on behalf of Habitat for Humanity Nova Scotia, is asking for more time to begin development of a previously approved residential development on lands off Drysdale Road and River Road in Halifax (PIDs 40311896 and 00334102).

Proposal

In September 2018, Halifax and West Community Council approved a development agreement to allow for a residential development on lands off Drysdale Road and River Road, Halifax (Case 20924). The development agreement requires development of the lands commence within four (4) years from the date the agreement was registered, which was November 22, 2018. 

The applicant wishes to amend the existing development agreement to allow a four (4) year extension to the date of commencement. An extension to the date of commencement is considered a non-substantive amendment as per Section 6.1 of the existing agreement.

The application documents are provided below and outline the requested amendment.

The application will be considered under the process for non-substantive amendments to a development agreement.

Documents Submitted for Evaluation

The applicant has submitted plans and studies required by municipal staff to properly evaluate the application. The documents are also available for review at the Planning Applications office in Downtown Halifax.
