NOTICE OF APPROVAL

TAKE NOTICE THAT a Development Officer of Halifax Regional Municipality did, on Wednesday, January 4th, 2023, approve the Amending Development Agreement to extend the deadline for time required for commencement and completion of development for the residential development off Charleswood Drive, Windsor Junction.
Any aggrieved person, the Provincial Director of Planning, or the Council of any adjoining municipality may, within fourteen days of the publishing of this notice on the HRM website, appeal to the Nova Scotia Utility and Review Board (902.424.4448), in accordance with the provisions of the Halifax Regional Municipality Charter.

Request

Clayton Developments Limited is applying to amend an existing development agreement (Case 22143) to allow for a five-year time extension to begin construction for the residential development off Charleswood Drive, Windsor Junction (PIDs 40699837, 41470295, 00510560, and 40092009).  This residential development is permitted through a development agreement which was approved by North West Community Council on November 9, 2020.

Proposal

The applicant wishes to extend the deadline in the development agreement to allow more time for construction.  This will extend the deadline for the commencement of development, which is defined as the issuance of the first occupancy permit, to March 31, 2029, to account for labour shortages, material shortages, and high interest rates.

Process

The application will be considered under the Non-Substantive Development Agreement Process. Under the Halifax Charter, non-substantive amendments can be approved by the Development Officer.
