NOTICE OF APPROVAL
HALIFAX AND WEST COMMUNITY COUNCIL

On January 16, 2024, Halifax and West Community Council approved the application to rezone 2 Marie Avenue, Halifax (PID 40306383) from the R-1, R-2 and H Zones to P (Park & Institutional) Zone.

Request

Application by Sunrose Land Use Consulting, on behalf of the owner, to rezone the 8.75 acre vacant property located at 2 Marie Avenue, Halifax from R-1, R-2 and H Zones to P (Park & Institutional) Zone to accommodate a Shared Housing with Special Care Use (long-term care facility).

Proposal

The subject site is located off Herring Cove Road and Marie Avenue. It falls under the Mainland South Secondary Plan of the Halifax Municipal Planning Strategy. The site was previously the Holly Drive School, which was demolished in 2002 and has since been vacant. 

The applicant is looking to rezone the property from R-1, R-2 and H Zones to P Zone to accommodate a Shared Housing with Special Care Use. The current proposal is a 3-level long-term care facility with 128 beds and surface parking.

The Development Plans (provided below) outline the development proposal in detail.

*Important Note:

The proposed rezoning would allow for any development permitted in the P (Park & Institutional) zone (below). Therefore, the proposed development (refer to site plan above) could change at the permitting stage, provided that the requirements of the Land Use By-law (LUB) are met. The P zone does not include restrictions on the height, massing, floor area, or architectural design of any proposed building. The P zone and LUB requirements only include the following: 
•    permitted uses, which includes “shared housing with special care” as well as parks, sportsfields, community facilities, schools, daycares, hospitals, churches, libraries, and other institutions; 
•    minimum building setbacks from property lines, which are 20 feet from the street right-of-way and 8 feet from the rear and side property lines; 
•    restrictions on signs on the building and site; and
•    minimum parking requirements, except that no parking is required for a Shared Housing use.

The application will be considered under the Rezoning process.

TAKE NOTICE THAT Halifax and West Community Council did, on Tuesday, January 16, 2024, approve the following: 

Case 2023-00651 - Application by Sunrose Land Use Consulting, on behalf of the owner, to rezone the 8.75 acre vacant property located at 2 Marie Avenue, Halifax from R-1, R-2 and H Zones to P (Park & Institutional) Zone to accommodate a Shared Housing with Special Care Use (long-term care facility).

Any aggrieved person, the Provincial Director of Planning, or the Council of any adjoining municipality may, within fourteen days of the publishing of this notice on the HRM website, appeal to the Nova Scotia Utility and Review Board (902.424.4448), in accordance with the provisions of the Halifax Regional Municipality Charter.

This notice was posted to this site on January 17, 2024 in accordance with the requirements of the Halifax Regional Municipality Charter.
