NOTICE OF APPROVAL
TAKE NOTICE THAT a Development Officer of Halifax Regional Municipality did, on Wednesday, August 30, 2023, approve the Amending Development Agreement to allow for a commercial use on lands at Marketway Lane, Timberlea.
Any aggrieved person, the Provincial Director of Planning, or the Council of any adjoining municipality may, within fourteen days of the publishing of this notice on the HRM website, appeal to the Nova Scotia Utility and Review Board (902.424.4448), in accordance with the provisions of the Halifax Regional Municipality Charter.
Request
ZZap Architecture and Planning is requesting non-substantive amendments to the existing development agreement for Brunello Estates to allow for a commercial use on lands at Marketway Lane, Timberlea to enable the new Mayflower Curling Club.
Proposal
The subject site is located to the southwest of the Sobey’s store on Marketway Lane, off Timberlea Village Parkway, Timberlea and abuts the Hwy. 103 interchange. The proposed site will be subdivided from the existing land parcel (PID 41499872) and will be approximately 12,370 sq. metres (5.8 acres).
The proposed amendment would allow the property to be used for a commercial use (commercial recreation use). The current proposal is for the Mayflower Curling Club and related parking and landscaped areas. The existing development agreement designates the site for commercial uses or mixed-residential.
Process
The application will be considered under the Non-Substantive Amendment to Development Agreement process.
*Pursuant to the HRM Charter, a decision on the proposal may be made by either the HRM Development Officer or by Council.
