Request to amend the Peggy's Cove Land Use By-law to add PID 40664377 (104 Peggy's Cove Road) to Section 7.4.9, which would permit the on‑site sale of arts and crafts as an accessory use on the property, zoned (S) Service and Facilities. The amendment recognizes the property’s longstanding function as a gallery with an accessory gift‑shop featuring locally produced items.

Regulatory Context

Halifax Regional Municipality has entered into a service agreement with the Province of Nova Scotia to administer the land use by-law and to process any requests for rezoning or land use by-law text amendments to the Peggy's Cove Land Use By-law on behalf of the Peggy's Cove Commission (PCC). Any property located within the Peggy's Cove Preservation Area (PCPA) will be reviewed and a decision rendered by the PCC.

Note: as per Section 10.8.1 of the Peggy's Cove Land Use By-law, a decision of the PCC regarding amendments to the Land Use By-law is not appealable to the Nova Scotia Regulatory and Appeals Board.

Process

The application will be considered under the Peggy's Cove Commission Land Use By-Law Amendment Process.

As per section 10.5.1 of the Peggy's Cove Land Use By-Law, a successful motion by the Commission was passed on January 15, 2026 to initiate the process to consider this amendment. An Initiation Memo was prepared and submitted to the PCC for consideration.

Status

Currently this application is in the public engagement stage and staff are now accepting feedback from the public regarding the proposed Land-Use By-law amendment. A Factsheet has been prepared containing details about the application.
