Important Notice – January 4, 2023
NOTICE OF APPROVAL: TAKE NOTICE THAT as per Section 245 of the Halifax Regional Municipality Charter, a Development Officer of Halifax Regional Municipality did, on January 3, 2023, approve the Amending Development Agreement to permit the subdivision of the lands on a registered heritage property.
Any aggrieved person, the Provincial Director of Planning, or the Council of any adjoining municipality may, within fourteen days of the publishing of this notice on the HRM website, appeal to the Nova Scotia Utility and Review Board (902.424.4448), in accordance with the provisions of the Halifax Regional Municipality Charter.

Request
Application by ZZap Consulting requesting to amend an existing Development Agreement on lands at 1029 Tower Road (PID 00142935), Halifax to allow the subdivision of the lands on a registered heritage property.
Proposal
The applicant has applied for a non-substantial amendment to the existing Development Agreement on the property (Case 23066) to:
• Be permitted to subdivide the existing property into two properties; and,
• Amend Schedule B – Site Plan to permit the removal of the sunken terrace on the modern building and the instatement of window wells.
The revised Site Plan (provided below) shows the location of the proposed subdivision and the proposed window wells on the modern building.
Process
The application will be considered as a non-substantial amendment to a Development Agreement, which will be reviewed and evaluated by the Development Officer.
Status
This application was approved by a Development Officer on January 3, 2022 and is within an appeal period. The Staff Report can be found here.
