That Halifax Regional Council grant permission for the Canadian Armed Forces to fly a CP-140 Aurora and CH-148 Cyclone in formation over the Sailors’ Memorial in Point Pleasant Park as per the diagrams attached to the correspondence dated March 22, 2019 at an altitude of 500 feet above the highest obstacles on Sunday May 5, 2019 at 10:58 AM in conjunction with the 2019 Battle of the Atlantic Ceremony.

15.1.1 Case 21916 – Municipal Planning Strategy / Land Use By-law Amendments and Development Agreement for a 12-storey mixed-use development at 3514 Joseph Howe Drive, Halifax [PDF]
Motion:

That Halifax Regional Council direct the Chief Administrative Officer to:
1. Initiate a process to consider amendments to the Halifax Municipal Planning Strategy and Halifax Mainland Land Use By-law to enable mixed-use development with a streetwall height of 5 storeys and an overall height of 12 storeys within ‘Area A’ of the Plan Dutch Village Road Area by development agreement; and
2. Follow the public participation program for municipal planning strategy amendments as approved by Regional Council on February 27, 1997.

15.1.2 Sullivan’s Pond Aquatic Weed [PDF]
Motion:

That Halifax Regional Council direct the Chief Administrative Officer to decline entering into a partnership with the Halifax and Area Model Yacht Club to conduct harvesting of aquatic weeds in Sullivan’s Pond.

15.1.3 Partial Declaration of Surplus Property and Partial Park Closure – Colby Village Green Area P-15 [PDF]
Motion:

That Halifax Regional Council:
1. Declare the portion of the park shown as ‘Area to be added to Surplus’ in Attachment ‘B’ of the staff report dated February 4, 2019, surplus to municipal requirements and be categorized as ‘Extraordinary’, as per Administrative Order 50;
2. Determine that the portion of the park shown as ‘Area to be added to Surplus’ in Attachment ‘B’ of the staff report dated February 4, 2019 is no longer needed for parks, playgrounds, or similar public purposes; and
3. Set a date for the Council meeting to consider closing that portion of park shown in Attachment ‘B’ of the staff report dated February 4, 2019 as “Area of Park to be Closed’ with notice to owners of the lots in the subdivision to be published in a newspaper at least fourteen days prior to the Council meeting.

15.1.4 Expansion of Halifax Public Wi-Fi [PDF]
Motion:

That Halifax Regional Council direct the Chief Administrative Officer to negotiate and execute amendments to the April 25, 2017 “Halifax Public Wi-Fi Solution Services Schedule” to the August 20, 2010 Master Services Agreement between HRM and Bell Aliant Regional Communications, and to the Statement of Work executed with Bell Aliant on August 17, 2017, that are in accordance with the Financial Implications section of the staff report dated February 21, 2019; and
i. Expand the existing public Wi-Fi program to include access points at Alderney Pedway and Upper Level Theatre, the Halifax Ferry Terminal, Alderney Ferry Terminal, the Lacewood Terminal, and Bridge Bus Terminal, as well as areas of the Public Gardens (Horticultural Hall and Plaza) and the Emera Oval (Pavilion and surrounding area); and
ii. Provide for the orderly termination and removal of access points at the Halifax Public Libraries’ public Wi-Fi sites 4, 5, and 6.

15.1.5 Remnant Property Disposal – Parcel A – Portion of PID No. 00397208, 3725 Old Sambro Road, Sambro [PDF]
Motion:

That Halifax Regional Council:
1. Approve the subdivision and the sale of Parcel A, being a portion of a parcel of land identified as current PID 397208 situated at 3725 Old Sambro Road, Sambro, Nova Scotia, to the Trustees of the St. James United Church of Canada (or their nominee) for the less than market value of $1.00, plus closing costs on terms to include the key terms and conditions outlined in Table 1 of the staff report dated March 13, 2019; and
2. Authorize the Mayor and Clerk of the Municipality to execute an Agreement of Purchase and Sale, the Deed and any other documents required to convey the said Parcel A to the Trustees of the St. James United Church of Canada (or their nominee).

15.2 AUDIT AND FINANCE STANDING COMMITTEE
15.2.1 Funding Request - Terence Bay Community Hall Association - Proposed Contribution Agreement [PDF]
Motion:

That Halifax Regional Council:
1. Approve the transfer of $75,000 from Operating Account M310-8004 to the General Contingency Reserve Q421 in fiscal year 2018-19;
2. Approve provision of a one-time capital contribution in the amount of $75,000 to the Terence Bay Community Hall Association towards capital improvements and upgrades to 80 Sandy Cove Road, Terence Bay, to be funded as a withdrawal from the General Contingency Reserve Q421 in fiscal year 2019-20; and
3. Authorize the Chief Administrative Officer, or their designate, to negotiate, enter into and execute a Contribution Agreement on behalf of the Municipality with the Terence Bay Community Hall Association substantially in the same form as the draft Contribution Agreement included as Attachment 1 of the supplementary staff report dated February 27, 2019, and otherwise acceptable to the Chief Administrative Officer.

15.2.2 Award – Tender 18-159 - New St. Andrew’s Community Centre [PDF]
Motion:

That Halifax Regional Council:
1. Approve an unbudgeted withdrawal in the amount of $480,000 (net HST included), from the Capital Fund Reserve, Q526;
2. Increase 2018/2019 Capital Project Number CB000011 – St. Andrew’s Community Centre Renovation by $480,000 (net HST included); and
3. Award Tender No. 18-159, New St. Andrew’s Community Centre, to the lowest bidder meeting specifications, PCL Constructors Canada Inc., at a cost of $10,334,743 (net HST included) with funding from Project Account No. CB000011 – St. Andrew’s Community Centre Renovations and Project Account No. CBX01162 Environmental Remediation/ Building Demolition, as outlined in the Financial section of the staff report dated February 19, 2019.

15.3 TRANSPORTATION STANDING COMMITTEE
15.3.1 Feasibility of Onboard Wi-Fi for Halifax Transit [PDF]
Motion:

That Halifax Regional Council direct the Chief Administrative Officer to:
1. Amend the April 25, 2017 “Halifax Public Wi-Fi Solution Services Schedule” to the August 20, 2010 Master Services Agreement between HRM and Bell Aliant Regional Communications, and the Statement of Work executed with Bell Aliant on August 17, 2017, to
a. provide for the orderly termination of each of the party’s rights and obligations with respect to the design, installation and operation of, and payment for, access points at the Halifax Public Libraries’ public wi-fi sites 4, 5 and 6; and
b. provide for the design, installation and operation of, and document payment arrangements for, access points at the Alderney Ferry Terminal, the Halifax Ferry Terminal, and the Lacewood and Bridge Bus Terminals.
2. In partnership with Halifax Public Libraries, begin a pilot program (lasting no longer than 12 months) to trial existing mobile library hotspots on up to 20 transit buses to gauge rider interest and understand support implications, subject to the successful negotiation and execution of relevant contract documents and purchase orders with HRM’s service provider(s).
3. Based upon rider interest and findings from the preceding pilot program, consider development of a business case for expanding the service to additional terminals and/or additional buses/ferries and present the results to Regional Council.

That Halifax Regional Council request a staff report to consider cost and implementation of weekly collection for recyclables to coincide with the new contract opportunity June 2021 for the Eastern Passage Area.

15.4.2 Councillor Karsten - Fisherman’s Cove Project Funding [PDF]
Motion:

That Halifax Regional Council request a staff report in response to a request for the Municipality to provide $566,000.00 in funding for the Fisherman’s Cove Development Association to participate in a $1.7 million dock project at Fisherman’s Cove.

2. Adopt the resolution required by FCM, in regard to the appointment as provided in Attachment 1 of the private and confidential report dated March 25, 2019; and
3. Not release the private and confidential report dated March 25, 2019 to the public.
