That Halifax Regional Council award Tender No. 17-220, Micro Surfacing Phase 1 – Various Locations, to the lowest bidder meeting specifications, Industrial Cold Milling Limited for a Total Tender Price of $1,794,064 (net HST included) with funding from Project Account Nos. CR000005 – Street Recapitalization and CKU01084 – Sidewalk Renewal, as outlined in the Financial Implications section of the staff report dated April 24, 2017.

14.1.4 First Reading Proposed By-law E-204, Amendments to By-law E-200, Respecting Encroachments Upon, Under or Over a Street – For the Purpose of Facilitating Accessibility [PDF]
Motion – Councillor Mason:
That Halifax Regional Council give First Reading to By-Law E-204, the purpose of which is to amend By-Law E-200, the Encroachment By-law, as set out in Attachment B to the staff report dated March 30, 2017.  

14.1.5 Proposed Amendments to Administrative Order 45, Respecting Private Road Maintenance – Road Maintenance Fee for Three Brooks Homeowner’s Association [PDF]
Motion – Councillor Whitman:
That Halifax Regional Council adopt the amendments to Schedule 2 of Administrative Order 45, Respecting Charges for Private Road Maintenance, by replacing the charge of no more than $580.00 annually with a charge of no more than $750 annually, as indicated in Appendix B of the staff report dated March 30, 2017.

14.1.6 Uniform Charge for Sheet Harbour Streetscape Program  [PDF]
Motion:
That Halifax Regional Council:
1. Approve the 2017-18 Operating Budget for Sheet Harbour Streetscape in the amount of $41,200 in gross expenditures and $41,200 in uniform charge revenues; 
2. Approve the 2017-18 Uniform Charge for Sheet Harbour Streetscape at the rate of $11.84 per property within the catchment area as defined in the map attached to the staff report dated May 3, 2017 as Appendix “A”; and, 
3. Direct the Chief Administrative Officer (CAO) to direct staff to review the budget and tax rate for Sheet Harbour Streetscape each year, based on the current service level, and return with a recommendation at or before the general tax rates are finalized for the applicable fiscal year.

14.1.7 First Reading Proposed By-law A-405, Amendments to By-law A-400, Respecting Alternative Voting – Special Elections and Method of Voting  [PDF]
Motion – Deputy Mayor Craig: 
That Halifax Regional Council give First Reading to By-law A-405, respecting amendments of By-law A-400, the Alternative Voting By-law, as set out in Attachment 2 of the staff report dated May 15, 2017.

14.1.8 Halifax Regional Water Commission (HRWC) Cost Sharing Agreement – Sidewalk Renewal – Leiblin Drive (Civic No. 1 Kenwood Avenue to Rockingstone Road), West Region [PDF]
Motion:
That Halifax Regional Council authorize the Director of Transportation and Public Works to enter into a cost sharing agreement and authorize reimbursement of an amount up to $790,411 (net HST included) to the Halifax Regional Water Commission for the Leiblin Drive sidewalk renewal, with funding from Project Account No. CKU01084 – Sidewalk Renewal, as outlined in the Financial Implications section of the staff report dated May 8, 2017.

14.1.9 Council Remuneration [PDF]

Motion:
That Halifax Regional Council:
1. Direct the Chief Administrative Officer (CAO) to direct staff to prepare amendments to Administrative Order 17, the Council Member Remuneration Administrative Order, the purpose of which is to provide:
i. That the change in the Nova Scotia Average Industrial Weekly (AIW) earnings from September to September as reported by Statistics Canada in October of each year be used to adjust remuneration for both the Mayor and Council each November 1st and that where the AIW for a given year indicates a reduction in the wages, there shall be no increase for the Mayor and Council in that year; and
ii. That where the Mayor or member of Council is legally prevented from participation in the HRM Pension Plan, they will be, at their option, enrolled in the HRM (Supplemental Executive Retirement Program) SERP program.  The affected member will contribute to the SERP at the same level as they would have had they participated in the HRM Pension Plan and HRM will match those contributions.
2. Request the Province of Nova Scotia to amend the HRM Charter to allow for the provision of Transition Allowances to members of Council who do not reoffer or are not re-elected. The level of Transition Allowance to be determined by Halifax Regional Municipality (HRM) Council.
 

14.2 NORTH WEST COMMUNITY COUNCIL
14.2.1
Area Rate for Kingswood Ratepayers Association [PDF] 
Motion:
That Halifax Regional Council:
(a) Expand the catchment area for the Kingswood Ratepayers Association uniform charge to include Kingswood North as identified in the map in Appendix B of the staff report dated May 4, 2017, and;
(b) That the annual uniform charge of $50 be levied on each of the taxable residential and commercial property assessments in the revised catchment area, effective with the 2017-18 fiscal year for the purpose of funding the recreational activities of the Kingswood Ratepayers.

14.2.2 Area Rate Fee for Three Brooks Homeowner’s Association [PDF] 
Motion:
That Halifax Regional Council approve that the annual uniform charge to be levied on each of the taxable residential property assessment within the mapped area depicted in Appendix A of the staff report dated May 4, 2017 be increased from $20 to $60 effective for the 2017-18 fiscal year for the purpose of funding the recreational activities of the Three Brooks Homeowner’s Association.

Motion:
That Halifax Regional Council use the following as a funding source for the Grant for Parking Lot Reconstruction: 
(a) $25,000 from the Capital District Funds, specifically 
a. District 7 - $5,000 
b. District 8 - $15,000, 
c. District 9 - $5,000; and, 
(b) $99,195.11 from the Risk Reserve - General Contingency Reserve (Q421).

14.4.1 Councillor Streatch -
Installation of crosswalk in Fall River [PDF]
Motion: 
That Halifax Regional Council request a staff report respecting the potential installation of a pedestrian crosswalk at the intersection of Highway 2 and Coach Avenue, crossing over to Fletcher Drive, Fall River. 
 
15. MOTIONS
15.1 Councillor Hendsbee

That Halifax Regional Council request a staff report for the establishment of an HRM by-law or Administrative Order (AO) to permit residents to secure a better on-site water supply (wells) that have gone dry or extremely low from drought conditions to apply for refinancing options to be made available through the municipality.

15.2 Deputy Mayor Craig
That Halifax Regional Council request a staff report and recommendation to consider a closure of a portion of Metropolitan Avenue, north of Nictaux Drive, Lower Sackville.
 

16. IN CAMERA (IN PRIVATE)
Council may rise and go into a private In Camera session, in accordance with Section 19 of the Halifax Regional Municipality Charter, for the purpose of dealing with the following:

16.1 Property Matter
A matter pertaining to providing instruction and direction to officers and employees of the Municipality pertaining to the acquisition / sale of land in regard to 

16.1.1 Industrial Parks – Lot Inventory Additions and Lot Minimum Unit Pricing – Private and Confidential Report 
Motion: 
That Halifax Regional Council:
1. Approve the lot inventory additions and minimum unit pricing for the Phase 12-6 lots in Burnside Industrial Park as per Table 1 of Attachment 1 of the private and confidential report dated May 9, 2017;
2. Approve the minimum unit pricing for the existing lot inventory as per Table 2 of Attachment 1 of the private and confidential report dated May 9, 2017; and
3. It is further recommended that the private and confidential report dated May 9, 2017 not be released to the public.


16.2 Contract Negotiations
A matter pertaining to contract negotiations and legal advice. 

16.2.1 Access Agreements between HRM and Trade Centre Limited
Motion:
That the Halifax Regional Council:
1. Authorize and direct the Mayor and Municipal Clerk to enter into the easement and license agreements described in the Discussion section of the private and confidential staff report dated May 10, 2017 (the “Access Agreements”) on behalf of the Municipality with the Trade Centre Limited (“TCL”), in respect of the lands on which the Scotiabank Centre and World Trade and Convention Centre (“WTCC”) are situated;   
2. Require the Access Agreements to be executed substantially in the form and with the content as is attached at Schedules A through F of the private and confidential staff report dated May 10, 2017, together with such changes to form or content as may be deemed by the CAO to be in the best interest of the Municipality; 
3. Authorize and direct the Mayor and Municipal Clerk to deal with HRM’s right of first refusal as discussed and outlined in the private and confidential staff report dated May 10, 2017; and
4. It is further recommended that the private and confidential staff report dated May 10, 2017 not be released to the public until the purchase and sale has been concluded.
