11.1 CHIEF ADMINISTRATIVE OFFICER
11.1.1 First Reading Proposed By-law S-1003, an Amendment to By-law S-1000, Respecting the Regulation of Sidewalk Cafes – To Permit Seasonal Café Owners to Apply for Annual Licenses and to Provide Additional Discretion to the License Administrator

Motion:
That Halifax Regional Council give First Reading to By-law S-1003, the purpose of which is to amend By-law S-1000, Respecting the Regulation of Sidewalk Cafes, as set out in Attachment C of the staff report dated October 19, 2020 to: 
1. Give the Licensing Authority discretion to consider the factors listed in section 15, including any mitigation, when determining if an annual sidewalk café license may be issued to an applicant; 
2. Give current seasonal sidewalk café license holders the opportunity to apply for an annual sidewalk café license prior to December 31, 2020; and 
3. Require owners be responsible for sidewalk snow removal where a sidewalk café license is issued. 

11.1.2 Moosehead – Community Name Correction* [PDF]
Motion:
That Halifax Regional Council maintain the current spelling of the community of Moosehead. 

11.1.3 Proposed Administrative Order 2020-013-OP, Respecting Child Care Centres - Municipal Child Care Policy [PDF]
Motion:
1. Adopt Administrative Order 2020-013-OP, Respecting Child Care Centres as set out in Attachment 1 of the staff report dated October 1, 2020; and 
2. Direct the Chief Administrative Officer to return to Council with proposed less than market value leases for non-profit child care centres currently leasing space in municipal facilities as the existing leases expire. 

11.1.4 2021 Council Meeting Schedule [PDF]
Motion:
That Halifax Regional Council: 
1. Suspend the rules of procedure under Schedule 6, the Executive Standing Committee Terms of Reference, of Administrative Order One, the Procedures of the Council Administrative Order, and
2. Approve the proposed 2021 Council meeting schedule as outlined in Attachment 1 of the staff report dated October 27, 2020.

11.1.5 Case CA0130 – Proposed Amendments to Administrative Order 29, Respecting HRM Civic Addressing Policies – Street Naming and Renaming from April 1, 2020 – July 14, 2020 [PDF]
Motion:
That Halifax Regional Council adopt the proposed amendments to Administrative Order 29, Respecting Civic Addressing Policies in order to approve:
1. the naming of five new private lanes as identified in Attachment A and Maps 1, 2, 3, 4, and 5 of the staff report dated October 27, 2020;
2. the naming of two public streets as identified in Attachment A and Map 6 of the staff report dated October 27, 2020; 
3. the renaming of a portion of Park Avenue, Dartmouth to Flotilla Lane, Dartmouth, as identified in Attachment A and Map 7 and 8 of the staff report dated October 27, 2020; and
4. the retiring of two private lane names, Covesedge Court, Eastern Passage and Lodge Cres, Halifax, as identified in Attachment A and Map 9 and 10 of the staff report dated October 27, 2020.

11.1.6 Case 23021 - Incentive or Bonus Zoning Agreement 1441 Hollis Street, Halifax [PDF]
Motion:
That Halifax Regional Council adopt and authorize the Mayor and Clerk to enter into and execute, the Incentive or Bonus Zoning Agreement as provided in Attachment B of the staff report dated October 30, 2020 for the six-storey, mixed-use building at 1441 Hollis Street, Halifax.

11.1.7 2020 Councillor Appointments to Various Boards, Committees, and Commissions [PDF]
Motion: 
That Halifax Regional Council:
1) Suspend the rules of procedures requiring the Executive Standing Committee and Community Councils to review the nominations outlined in this report and make a recommendation to Halifax Regional Council;
2) Appoint the Councillors to Boards, Committees and Commissions for a term to November 2022, as outlined in Attachment 1 of the staff report dated November 9, 2020; and
3) Appoint the Councillors to Boards, Committees and Commissions who are the successful candidates after a vote by secret ballot for a term to November 2022, (and two of the Councillors to the Halifax Water Board of Commissioners for a term to November 2023), as outlined in Attachment 2 of the staff report dated November 9, 2020.

11.1.8 Rapid Housing Initiative Agreement [PDF]
Motion:
That Halifax Regional Council direct the Chief Administrative Officer to enter into the Rapid Housing Initiative Agreement with Canada Mortgage and Housing Corporation ("CMHC"), as provided in Attachment A of the staff report dated November 11, 2020, to accept $8,659,527 for the creation of a minimum of 28 affordable housing units. 

 

11.2 COMMUNITY PLANNING AND ECONOMIC DEVELOPMENT STANDING COMMITTEES
11.2.1 Case H00466 - Heritage Conservation Districts (HCDs) Prioritization and Process Review

That Halifax Regional Council:
1. Direct the Chief Administrative Officer to prioritize the adoption of new Heritage Conservation Districts in the following order: 1) Downtown Dartmouth; 2) Old North Suburb; and 3) Creighton’s Field; and
2. Repeal the Existing Public Participation Program for Heritage Conservation Districts (HCDs) as contained in Attachment E of the staff report dated August 19, 2020 and adopt a revised Public Participation Program for HCDs as contained in Attachment F of the staff report dated August 19, 2020.

11.3 DESIGN REVIEW COMMITTEE
11.3.1 Improvements to Downtown Halifax Substantive Site Plan Approval and Appeal Processes*

Motion:
That Halifax Regional Council request a staff report outlining options to improve the downtown Halifax substantive site plan approval and appeal processes, with consideration given to:
a) that staff submit a completed Site Plan Approval Application recommendation report to the Design Review Committee before the expiry of 40 days of the 60 day Charter time limit for DRC decisions, in order to enable the DRC sufficient time to consider an application;
b) the DRC receive written notification from the Clerk’s Office when a notice of appeal is filed with respect to a decision made by the DRC; 
c) Regional Council inviting a member of the DRC to attend the appeal hearing of a DRC decision; 
d) when an appeal of a DRC decision is scheduled to be heard by Council, requiring the DRC to forward a memorandum to Regional Council outlining the decision of the committee with a summary of the reasons for the decision.

11.4.1 Case H00483 – Substantial Alteration to the Municipally Registered Heritage Property at 5241-5247 South Street, Halifax*

That Halifax Regional Council approve the proposed substantial alteration to 5241-5247 South Street, Halifax, as set in the staff recommendation report dated September 4, 2020.

11.4.2 Case H00499 – Application for Substantial Alteration to 1029 Tower Road, Halifax, a Registered Municipal Heritage Property* [PDF]

That Halifax Regional Council approve the substantial alteration of 1029 Tower Road, Halifax, known as the Dr. James Doull House, as set out in the staff recommendation report dated September 4, 2020. 

11.5 MEMBERS OF COUNCIL
11.5.1 Councillor Austin - Use of the term Micmac on Municipal Streets and Facilities

Motion:
That Regional Council request a staff report on renaming Micmac Boulevard, the Micmac Transit Terminal, and Micmac Drive in Dartmouth, and Micmac Street and Micmac Court in Halifax. The report should consider:
1. Whether the east-west portion of Micmac Boulevard from the current intersection of Glen Manor Drive should become part of Glen Manor to better fit HRM’s current policies for street names
2. A new commemorative name for the portion of Micmac Boulevard that extends from the intersection of Glen Manor to the intersection of Lancaster/Woodland that reflects the former Black community that previously existed in the area for approximately 200 years
3. Whether the Micmac Transit Terminal should be given the same commemorative name as Micmac Boulevard or a new one of its own
4. New or corrected names for Micmac Street, Micmac Court, and Micmac Drive.

That Halifax Regional Council request a staff report to update the procurement policy and options for a "Buy Local" provision.

That Halifax Regional Council request a staff report that identifies any forms of preferential or prejudicial language, related to race, in any HRM By-laws or Administrative Orders.    

12.3 Councillor Mancini
Motion:

That Halifax Regional Council request a staff report and recommendation with respect to amendments to Administrative Order 2020-009-ADM, the COVID-19 Administrative Order, to enable in person public hearings and other changes resulting from the evolution of the Restated Order of the Chief Medical Officer of Heath under Section 32 of the Health Protection Act 2004.
