Case 16620 - IN THE MATTER OF an antenna tower siting impasse filed by Eastlink with Industry Canada against Halifax Regional Municipality of the decision of non-concurrence for the locating and erecting of a proposed 76.5 metre telecommunication antenna tower off of Crowell Road in Lawrencetown, Nova Scotia.

Case 16912 - HRM-initiated application to reformat and complete housekeeping amendments of the Dartmouth Land Use By-law.

Case 17272 - Application by North West Community Council to review the Cushing Hill Commercial Comprehensive Development District (CCDD) policies to consider new policy related to commercial and/or residential development on the lands within the CCDD.

Case 18322 - Application by Geoff Keddy and Associates for the lands at the corner of Coburg Road and Seymour Street, Halifax, to amend the Municipal Planning Strategy for Halifax and Land Use By-law for Halifax Peninsula to develop a 5 storey mixed use building with penthouse through a development agreement.

Case 18966 - Application by APL Properties Limited to amend the Halifax Municipal Planning Strategy and Halifax Peninsula Land Use By-law to permit the application of a development agreement allowing a mixed use development consisting of two new residential towers of 28 and 12 storeys respectively on a common two to three storey podium at 6009-6017 Quinpool Road, Halifax.

Case 18983 - Application by Ocean View Continuing Care Centre to enter into a development agreement to allow a 50 unit Residential Care Facility at 1955 Caldwell Road, Eastern Passage.

Case 19056 - Application by W.M. Fares Group Limited on behalf of Cascades Property Group to amend the Sackville Municipal Planning Strategy and Land Use By-law to consider development of townhouse and multiple unit dwelling uses at 26 and 34 Walker Service Road, Lower Sackville.

Case 19110 - Application by KWR Approvals Inc, for the lands of 3247003 NS Ltd to enter into a development agreement for a 10 storey mixed use (commercial/residential) building with approximately 58 residential units and 6,800 square feet of commercial space at 592 Bedford Highway, Halifax.

Case 19117 - Application by Cygnet Properties for lands identified as PID 00513788, on an extension of the Old Truro Road, Elmsdale, for a development agreement to allow a 525-site mobile home park.

Case 19158 -Application by Armco to amend the Municipal Planning Strategy (MPS) for Eastern Passage/Cow Bay to allow a mixed residential development by development agreement on lands located on Hines Road in Eastern Passage.

Case 19207 - Application by Bell Mobility to consider the locating of a 75 meter self-supporting telecommunication tower and associated equipment shelter off Three Fathom Harbour Road in Three Fathom Harbour.

Case 19238 - Application by Lucas Dambergs to convert an existing non-conforming commercial space into a residential unit at 2631A&B-2639 Fuller Terrace, Halifax.

Case 19258 - Application by WM Fares Group, for lands at 8 Linden Lea in Dartmouth, to amend the Downtown Dartmouth Secondary Planning Strategy (SPS) to create an opportunity site and enable a development agreement.

Case 19281 - Application by Westwood Construction Limited to amend the Halifax Municipal Planning Strategy and Halifax Peninsula Land Use By-law to permit the application of a development agreement allowing an 18-storey development containing a mix of residential, commercial, and hotel uses at 2032-2050 Robie Street, Halifax.

Case 19426 - Application by Kenting Properties Inc. to enter into a development agreement to enable a mixed use project consisting of 2 commercial buildings and a 48 unit 4 storey residential building at 1095 and 1101 Cole Harbour Road, Cole Harbour. Current applicable MPS policy and Land Use By-law regulations do not permit this type of mixed use development on the site by the as-of-right development process, and as such a development agreement to enable such a development to occur must be considered by Council.

Case 19461 - Application by Scotian Materials to amend the Planning District 1 and 3 Land Use By-law to enable an asphalt plant north of Highway 103 and west of Little Indian Lake, Head of St. Margarets Bay.

Case 19500 - Application by WSP Group for approval of a development agreement to enable a 10 storey mixed use building containing ground commercial space, 8 townhouse units and 82 apartment units at 169 Wyse Road.

Case 19514 - Southwest Properties proposes to amend the Halifax Municipal Planning Strategy and Mainland Land Use By-law to establish a mixed-use subdivision development on the Motherhouse lands, Halifax.

Case 19528 - Application by Michael Napier Architecture for approval of a development agreement to enable a 7 storey building containing 49 residential units on a property located at 181 Pleasant Street, Dartmouth.

Case 19531 - Application by WM Fares Group, on behalf of Young Developments Inc. to amend the Halifax Municipal Planning Strategy (MPS) and Halifax Peninsula Land Use By-law (LUB) to permit the application of a development agreement allowing a mixed use development consisting of three new buildings including 5, 16 and 21 storey towers at the northeast corner of Windsor Street and Young Street, Halifax.

Case 19532 - Application by WM Fares for a Stage I Development Agreement located on the lands located at Washmill Lake Drive and Regency Park Drive, Halifax, for a mixed commercial and residential development.

Case 19535 - Geoff Keddy Architect & Associates Limited proposes to amend the Municipal Planning Strategy (MPS) and Land Use By-law (LUB) for Timberlea/Lakeside/Beechville to permit commercial development at 1839 & 1841 St. Margarets Bay Road, Timberlea.

Case 19536 - Application by Metro Premier Properties Inc. to consider a development agreement for an expansion to an existing industrial use at 424 Caldwell Road.

Case 19554
- With the Stage I Development Agreement and the Stage II Development Agreement for Phase 1 now in place, WM Fares Group has requested Stage II Development Agreements for Phases 2 and 3.  This application also requests an amendment to the existing Stage II Development Agreement for Phase 1.

Case 19599 - Application by Sunset Towers Apartments Ltd to enter into a development agreement on the lands at 335 and 337 Portland Street in Dartmouth.

Case 19602- Application by Lee Theriault, for lands at Old Miller Road (see Site Plan below), Cole Harbour, for an amendment to the Cole Harbour/Westphal Land Use By-law. The subject lands are located within the Cole Harbour/Westphal plan area. The lands are designated RR (Rural Residential) and zoned UR (Urban Reserve) under the Cole Harbour/Westphal Municipal Planning Strategy and Land Use By-law respectively. UR permits single unit dwellings on existing lots with on-site sewage treatment and wells. The lands are designated Urban Reserve under the Regional MPS. The proposed rezoning has been applied for under Policy IM-18 of the Regional MPS. Policy IM-18 (a) enables Council to consider the establishment of a single unit dwelling land use subject to specific policy criteria for uses permitted on abutting designations and for uses permitted in the zone on the abutting designation. Policy SU-14 must also be considered in this request as it must be met in order to expand the Water Service boundary.

Case 19625- Application by West Bedford Holdings Limited to amend the existing development agreement for Sub-Area 5 of Bedford West.

Case 19626
- Application by W.M. Fares Group to amend the Dartmouth Municipal Planning Strategy (MPS) and Land Use By-law (LUB) to enable a mixed use project consisting of a commercial/office building and a 5 storey residential building at the corner of Portland Street and Portland Hills Drive, Dartmouth.  Current applicable MPS policy and Land Use By-law regulations do not permit this type of mixed use development on the site, and as such amendments to both documents are necessary to enable such a development to occur.

Case 19627- Application by KWR Approvals Limited to consider a site specific amendment to the Municipal Planning Strategy (MPS) for Beaver Bank, Hammonds Plains and Upper Sackville to permit a pub at 1345 and 1355 Hammonds Plains Road (Edible Matters).

Case 19694- Application by Sunrose Land Use Consulting, for lands at Coulter Crescent (off Frenchman’s Road) in Oakfield, to amend an existing development agreement to allow additional lands as part of an hybrid open space design development.

Case 19716- Application by Scotian Materials Limited to amend the Municipal Planning Strategy and Land Use By-law for Planning Districts 14 and 17 (Shubenacadie Lakes) to permit extractive facilities, an asphalt plant and a concrete plant in support of a quarry on the property idenfied as PID # 00505941 Perrins Drive, Goffs.

Case 19722 - Application by Melville Ridge Holdings Limited, to amend the Halifax Municipal Planning Strategy (MPS) and Halifax Peninsula Land Use By-law (LUB) to enable commercial uses and enter in to a development agreement to permit said commercial uses and to enable an enlargement to the building to enable a mechanical room at 15 Shoreham Lane, Halifax.

Case 19755- Application by CBCL Limited to rezone lands of Nova Scotia Innovation Corporation located on Research Drive and Neptune Crescent in Woodside Business Park from S (Institutional) Zone to I-1 (Light Industrial) Zone.

Case 19800- Application by Kiann Management Limited to rezone 38 acres from the RE (Rural Enterprise) zone to CD-2 (C&D Materials Processing Facilities) zone to permit a Construction and Demolition Waste Processing Facility at PID 40740276 Highway 7, Porters Lake.

Case 19858 - Application by WM Fares for the lands of 6345 Coburg Road to amend the Municipal Planning Strategy for Halifax and Land Use By-law for Halifax Peninsula to develop a multiple unit residential building.

Case 19910- 3274606 NS Ltd. is applying to amend the existing development agreement to allow an automotive repair use at 830 Highway 7, Westphal (PID 00650689).

Case 19927- Application by KWR Approvals, for lands at 1818 Shore Road, to rezone lots from R-1 (Single Unit Dwelling) to R-2 (Two Unit Dwelling), Eastern Passage.

Case 19987 - Application by Dino Capital Limited to enter into a Development Agreement which would allow a multi-unit residential development of 8 to 10 storeys in height (plus top floor common area) containing 170 residential units and 150 parking stalls on the properties located at 1034, 1042, 1050 and 1056 Wellington Street, Halifax.

Case 19989 - Application by FS Industries to amendment the Stage I and Stage II Development Agreement for Rockingham Ridge to allow for the development of a commercial building at 30 Farnham Gate Road.

Case 20054- Application by United Gulf Developments Ltd to amend the existing development agreement on the lands to allow for an increase to the amount of commercial floor area permitted within the existing buildings at 771 to 819 Bedford Highway, Bedford.

Case 20100 - Application by Ekistics Planning and Design, for the lands of Nanco Developments Limited, to rezone 214, 216 and 218 Herring Cove Road, Halifax from R-2P (General Residential Zone) to R-3 (General Residential and Low Rise Apartment Zone) and RC-1 (Neighbourhood Commercial Zone) and consider text amendments to the Halifax Mainland Land Use By-law to enable a four storey mixed use building including 38 dwelling units and 2000 square feet of neighbourhood commercial space on the ground floor.

Case 20102 - Application by TEAL Architects, on behalf of FH Construction Ltd., to amend the Halifax Community Plan to allow for an up to 10-storey mixed-use building at 383 Herring Cove Road, PID 00333070, Halifax by development agreement.

Case 20110 & 20264 - Application by WSP on behalf of Marque Investments to enable the development of two vacant properties totaling 157 Ha (387 acres) in size located on Windgate Drive, Beaver Bank, NS.

Case 20120 -Request by WSP Canada Inc. to rezone lands of F. H. Construction Limited located on Herring Cove Road, Parkmoor Avenue and Charlton Avenue in Halifax, from R-1 (Single Family Dwelling) Zone to R-2 (Two-Family Dwelling) Zone.  

Case 20136 - Application by Southern Comfort Construction Inc. to rezone 26 Bissett Road, Cole Harbour, from R-2 (Two Unit Dwelling) Zone to R-4 (Multiple Unit Dwelling) Zone to permit a 4 unit multiple dwelling.

Case 20141 - Application by WSP Canada Inc for the lands of Brunello Estates Inc. to amend the existing development agreement on the lands (Case 00265) to allow for reduced frontage single unit dwellings (with a lot frontage between 34 feet and 39 feet) to be located on Boulevards and Modified Urban Collector Roads.

Case 20149 - Application by WSP Group to amend the Land Use Bylaw for Halifax by including lands located at 2866 & 2858 Gottingen Street and 5518 Macara Street within Schedule Q; and to enter into a development agreement to allow an 8-storey, 71-unit building with ground floor commercial space.

Case 20151 - Application by Banc Properties Limited to enter into a development agreement to allow a 6 unit townhouse project on lands located on Kelly Street, Halifax.

Case 20156 - Application by DePint Developments Ltd to rezone lands located on Lynn Road, Elizabeth Drive and Withrod Drive from the R-1 (Single Family) Zone to the R-2 (Two-Family Dwelling) Zone to enable construction of two semi-detached buildings (4 units total).

Case 20183 -Application by WSP Canada to amend the Land Use Bylaw for Halifax Peninsula be applying Schedule Q to lands located at 2710 Agricola Street, and for approval of a development agreement to enable a 7 storey mixed use building with 69 units.

Case 20211 - Amendments to the Bedford Municipal Planning Strategy (MPS) and Land Use By-law (LUB) to allow service stations within the ILI (Light Industrial) Zone, Bedford.

Case 20215 - Application by Canadian International Capital Inc. has applied to amend the Timberlea, Lakeside and Beechville Land Use By-law (LUB) to enable microbreweries as a permitted use in the C-2 (General Business) Zone.

Case 20216 - Application by Armco Capital and Emscote Limited to amend the existing development agreements for Royale Hemlocks and Emscote subdivisions to enable approximately seven new residential lots at 124 Cutter Drive, 317 Starboard Drive and on a lot located west of 316 Starboard Drive, Halifax.

Case 20224 - Application by WSP Canada Inc., on behalf of Kent Building Supplies Ltd., to amend the Sackville Municipal Planning Strategy (MPS), Sackville Drive Secondary Planning Strategy (SPS) and associated Land Use By-laws to permit the expansion of the Kent Building Supplies store located at the intersection of Sackville Drive and Beaver Bank Road in Lower Sackville.

Case 20231 - Application by WM Fares Group to rezone lands located at 2728 Joseph Howe Drive, Halifax from R-1 to R-2T to permit the construction of five townhouse units.

Case 20235 - Application by CBCL Limited to rezone lands of Clearwater Fine Food Incorporated located at 101 Research Drive in Woodside Business Park, Dartmouth, from S (Institutional) Zone to I-1 (Light Industrial) Zone.

Case 20246 - Application by Upland Urban Planning + Design Studio to rezone a portion of the former Briarwood Golf Course lands on Herring Cove Road from R-1 (Single Unit Dwelling) Zone to R-2 (Two-Unit Dwelling) Zone.

Case 20247
- An application by RMP Development Consulting Limited has been made to enter into a Development Agreement for an equestrian farm at 1481 Lucasville Road, Lucasville, known as Restless Pines Farms.  The current zoning permits agricultural uses on the property however a development agreement is required for the existing commercial recreational operations there.

Case 20260 - Eastpoint Engineering is applying for non-substantive amendments to the existing development agreement that permits the development of 16 townhouse units within 4 buildings located at Evergreen Drive.

Case 20265 - Application made by WSP Canada Inc., on behalf of Banc Properties Ltd., to amend the minimum watercourse setback required under the I-3 (General Industrial) Zone of the Halifax Mainland Land Use By-law.

Case 20269 - Monaco Investments Partnership is applying to:

  1. rezone lands located at 307 Prince Albert Road from C-2 (General Business) to GC (General Commercial);
  2. rezone lands located at 5 Glenwood Drive from R-2 (Two Family Dwelling) to R-4 (Multiple Family Residential - High Density); and
  3. enter into a development agreement to allow a 10 storey residential building containing approximately 90 units with ground floor commercial uses on the combined site.

Case 20284 - An application by Ekistics Plan + Design has been made to enter into a Development Agreement for a 9 hole golf course with a maintenance building at 2108 Hammonds Plains Road (PID 00421248), PID 40702474 and PID 41189002.  The current zoning permits multiple uses on the property, however, a development agreement is required for a commercial recreation use. There is an existing development agreement on a small portion of each of the lots that was originally approved for a quarry (Case # 91065) which will be discharged.

Case 20293 -
Application by UPLAND Urban Planning + Design Inc. to discharge an existing development agreement and enter into a new development agreement for a 12-storey mixed-use commercial and residential building at 910 Bedford Highway, Bedford.

Case 20325 - Application by Emscote Limited for a substantive amendment to the development agreement for Wentworth Estates to change the housing mix with no increase in density, resulting in 21 townhouses and two 8-unit apartment buildings on Parcel TR100 and a 142-unit apartment building on Parcel E-R8, Transom Drive, Halifax

Case 20326 - Application by Michael Napier Architecture for a substantive amendment to a development agreement to alter the exterior design and density of a mixed use building at 5534-5558 Bilby Street, Halifax.

Case 20332 - Application by Armco Capital to enter into a development agreement to permit a 5,000 sq ft commercial building on a 0.5 acre site between Hamilton Drive and Rosemary Drive, Sackville (PID 41158858)

Case 20350 - Right and Ready Homes Inc. is applying to enter into a development agreement for lands located at 1224 Highway No. 7, Westphal, to allow the development of a multi-use recreation facility.

Case 20359 - Application by WM Fares Architects for a Stage II Development Agreement for Phase 4 of Rockingham South to allow for 4 multiple unit residential buildings with 430 units.

Case 20375 - Application by WM Fares Group to amend the existing Stage I Development Agreement for Rockingham South to allow the Municipality to consider a Stage II Development Agreement for Phase 4 prior to the issuance of 75% of the occupancy permits in the earlier phases.

Case 20387 - T. A. Scott Architecture and Design Limited is requesting to enter into a development agreement for lands located at Portland Street in Dartmouth to enable a mixed use development.

Case 20395 - Application by Environmental Design Management (EDM), on behalf of Dartmouth Crossing Limited, to rezone lands located north of Commodore Drive and west of Finlay Drive in Dartmouth Crossing from the I-2 (General Industrial) Zone to the BCDD (Burnside Comprehensive Development District) Zone and to enter into a development agreement to allow for two multiple-unit residential buildings.

Case 20384 - Application by West Bedford Holdings to enter in to a development agreement to enable three, 12-storey, and one, 6-storey multiple unit residential buildings on Innovation Drive near Hammonds Plains Road and Angus Morton Drive, Bedford.

Case 20386 - W. M. Fares Group submitted an application to amend the existing Development Agreement Case# 01302 to permit a fascia sign with their corporate logo at the top level of the existing commercial/office building at 3480 Joseph Howe Drive, Halifax.

Case 20401 - Application by Sunrose Land Use Consulting to amend the Bedford and Halifax Municipal Planning Strategy (MPS) and the Bedford West Secondary Planning Strategy to enable development of Bedford West Sub Area 10, Kearney Lake Road, Bedford and Halifax.

Case 20405 - Application by Halifax Grammar School to amend the Halifax MPS and LUB to enable the enable the rezoning of 915,921 and 967 Tower Road and a portion of 945 Tower Road from R-1 to P (intitutional), Tower Road, Halifax.

Case 20406 - An application by Lydon Lynch Architects Limited has been made to enter into a development agreement to enable a conversion from hotel use to multiple unit buildings. The zoning currently permits a multiple unit dwelling on the property, however, a development agreement is required for apartment buildings of 3 units and beyond.

Case 20417 - Studio Works International Ltd. is requesting to enter into a development agreement for lands at 2267 Brunswick Street in Halifax.

Case 20437 - Application by Armco Capital and Emscote Limited to amend the existing development agreements for Royale Hemlocks and Emscote subdivisions to enable approximately seven new residential lots at 124 Cutter Drive, 317 Starboard Drive and on a lot located west of 316 Starboard Drive, Halifax.

Case 20447 - Application by Canadian International Capital Inc. for non-substantive amendments to the existing Development Agreement for Brunello Estates to allow 2 buildings consisting of a total of 134 units.

Case 20449 - Application by Arbor Vitalia Courtyard Properties Limited for Substantive Amendments to add 9-10 residential units in the existing Club House, located in Block C, Washmill Lake Drive in Clayton Park West, Phase V. The proposal will not create changes or alterations to the volume, size or exterior appearance of the building.

Case 20450 - Application by API Consultants Limited to amend the Stage 2 development agreement applicable to 980 Parkland Drive, Halifax to allow an additional 7 hotel rooms (for 120 rooms total) through the conversion of internal, ground floor space within an existing hotel.

Case 20489 - Studio Works International Inc. has submitted a request to enter into a development agreement to allow for a residential penthouse on the sixth level of a commercial building. A single residential unit is a permitted use; however, the existing property does not meet the minimum lot area for a single residential unit. A lot modification development agreement is being requested in accordance with Implementation Policy 4.6 of the Halifax Municipal Planning Strategy.

Case 20501 - An application by Shelley Dickey Land Use planning has been made to enter into a development agreement for senior citizen housing at 15 Brenda Drive in Hammonds Plains. The zoning currently permits a single unit dwelling on the property, however, a development agreement is required for the existing seniors housing.

Case 20504 - Application by Personal Care Holdings Limited to enter into a development agreement to permit a landscaping business at 387 Cobequid Rd, Lower Sackville (PID 00355115).

Case 20506 - Request by Amadesco Canada to rezone lands of Sack A Wa Canoe Club located at 159 First Lake Drive, Lower Sackville from R-1 (Single Unit Dwelling) Zone to P-2 (Community Facility) Zone.

Case 20510 - Regional Council-initiated amendment to the Halifax Municipal Planning Strategy and the Halifax Peninsula Land Use By-law to create a site specific zone for 6067 Quinpool Road, the former St. Patrick’s High School property.

Case 20540 - Application by WSP Canada Inc. to amend the existing Development Agreement applicable to PID 41350497 to allow lot subdivision and to relocate previously approved underground parking access.

Case 20589 - Ms. Lorna Snair is applying to amend to the Musquodoboit Valley/Dutch Settlement Municipal Planning Strategy (MPS) and Land Use By-law (LUB) and the Halifax Regional Subdivision By-law to enable the subdivision of her lands into 6 lots in Meaghers Grant.

Case 20594 - Application by GFC Management Lt. to amend the Municipal Planning Strategy and Land Use By-law for Planning Districts 14 and Land Use By-law for Planning Districts 14 and 17 to enable the development of four- 5 story multiple unit dwellings for seniors at the former Carr Farm situated at 1109, 1075 and 1085 Fall River Road, Fall River.  

Case 20640 -Application by WSP Canada Inc., on behalf of Premax Atlantic Vistas Inc (Premax), for substantive amendments to an existing Developmen Agreement that enables a mixed-use residential and commercial development located at 656,660 and 664 Bedford Highway. The requested amendments are to increase the maximum number of permitted units from 98 to 107.

Case 20758 - Application by WSP Canada Inc. to amend the Stage II Development Agreement for Phase 3 of Rockingham South to permit a gas station and retail store at the corner of Dunbrack Street and Ruth Goldbloom Drive.

Case 20762 - Application by WSP. Canada Inc. on behalf of PF Properties Ltd.  to enter into a development agreement on lands located off Lynnett Road, Autumn Drive, and McIntosh Street to allow a residential development.

Case 20795 - Application by Sunrose Land Use Consulting to re-zone and enter into a development agreement on lands partially fronting Raines Mill Road, Lakeside to allow a residential building containing 40 units and 40 single unit dwellings.

Case 20800 - The Application by Summit Rock Developments Ltd. on behalf of Conrad Brothers Ltd. requests that Harbour East-Marine Drive Community Council amend the boundaries of the District 14 and 17 Municipal Planning Strategy and Land Use Bylaw to include the entirety of the subject lands and to rezone the subject properties to permit industrial and highway commercial activities.

Case 20832 - An application has been made by West Bedford Holdings Limited to make non-substantive amendment to the Sub-Area 2 Bedford West Development Agreement. The proposed amendments involve changes to the road layout and relocation of single unit and multiple unit dwellings within allowable densities. The existing development agreement outlines that changes such as those proposed be considered as non-substantive amendments, which do not require a public hearing in advance of Council’s decision.

Case 20996 - Application by Cresco Holdings Ltd. for non-substantive amendments to an existing development agreement within Subarea 9 of the West Bedford Secondary Planning Strategy to allow additional commercial uses.

Case 21012 - Application by WSP Canada Inc on behalf of Hamton Holdings Limited to enter into a development agreement on lands on the southwestern corner of Damascus Road and Duke Street, Bedford to allow for a reduction in the setback from an environmentally sensitive area.
