Name: Warden's Retiring Allowance By-law

BE IT RESOLVED that the following be and the same is hereby adopted and enacted as a By-law of Halifax County Municipality when and if the same has received the approval of the Minister of Municipal Affairs, and that the Municipal Clerk be and he is hereby instructed to forward the same to the Minister and request his approval hereof.

WARDEN'S RETIRING ALLOWANCE BY-LAW

1. This By-Law may be cited as the Halifax County Warden's Retiring Allowance By-Law.

2. (1) Where a person

(a) has been a member of the Council of Halifax County Municipality for at least fifteen years;

(b) was a member of the Council any time prior to the coming into force of this Act;

(c) has served as Warden of the Council on a fulltime basis for at least two terms and each term was a least three years in length;

(d) has attained the age of at least sixty-five years;

(e) has ceased to be a member of the Council; and pursuant to any plan established by the Municipality, other than the annuity to which this Act relates,

(f) is not entitled to a retiring allowance,

the Council shall grant an annuity to that person in the amount of six thousand dollars per year.

(2) An annuity granted pursuant to subsection (1) is payable in monthly instalments not in advance for and during the remainder of the life of the person to whom the annuity is granted but ceases to be payable if that person becomes entitled to a retiring allowance pursuant to any plan established by Halifax County Municipality, other than the annuity to which this Act relates.

2. (3) For greater certainty, an annuity may be granted to a person pursuant to subsection (1) where that person;

(a) either was, before the coming into force of this Act, or is, on or after the coming into force of this Act, Warden of the Council; and

(b) either became, before the coming into force of this Act, or becomes, on or after the coming into force of this Act, a member of that class of persons to whom an annuity may be granted pursuant to subsection (1).

THIS IS TO CERTIFY that the By-Law of which the foregoing is a true copy was duly passed at a duly called meeting of the Municipal Council of Halifax County Municipality duly held on the 4th day of July, A.D. 1989.

GIVEN under the hand of the Municipal Clerk and under the corporate seal of the said Municipality this 12th day of July, A.D. 1989.

The Warden's Pension By-law, Number 62, for Halifax County Municipality which was adopted at a meeting of Halifax County Council held on July 4, 1989, is approved, pursuant to Section 24 of the Municipal Affairs Act, with the following amendment:

1. Insert immediately after the first line of clause (e) of subsection (1) of Section 2 the following:

"(f)is not entitled to a retiring allowance".
