Request

Application by WSP on behalf of the property owner for a substantive amendment to a development agreement at 131 Hanwell Drive in Middle Sackville to amend section 6.2 of the original development agreement to allow for an extension to the commencement and completion dates of the development.

The applicant is requesting substantive amendments to the existing development agreement which permits a mixed-use development consisting of a 4-storey building with one level of underground parking.

The proposed amendment includes a request to extend the commencement of construction date by eight (8) years as shown in section 8.3.3 of the existing development agreement and extend the completion of construction date by eight (8) years as shown in section 8.3.4. of the existing development agreement.

The major aspects of the proposal are as follows:

  • Extend the commencement of construction date for the mixed-use building by eight (8) years as shown in section 8.3.3 of the existing development agreement.
  • Extend the completion of construction date for the mixed-use building by eight (8) years as shown in section 8.3.4. of the existing development agreement.
  • Add sections 8.3.3 and 8.3.4 to section 6.2c of the existing development agreement which would allow any future need for an extension to the commencement and completion date in the development agreement to be considered as non-substantive.

The existing development agreement (provided below) shows the development proposal in detail, and includes information related to proposed buildings, driveway access, and landscaping.

Process

The application will be considered under the substantive alteration to an existing development agreement process. 

Status

A public hearing will be held by North West Community Council on January 12, 2026 at 6:00 p.m. at Halifax City Hall (Council Chamber), 1841 Argyle Street, Halifax, NS.
