That Halifax Regional Council adopt proposed By-law V-200, the Vehicle Immobilization By-law, as set out in REVISED Attachment A of the staff report dated May 28, 2021.

11.1.2 Award – Request for Quotation (RFQ) 21-340, Collection and Transportation of Source-Separated Solid Waste from Condominium Properties[PDF]
Motion:
That Halifax Regional Council award RFQ 21-340, Collection and Transportation of Source-Separated Solid Waste from Condominium Properties, based on the lowest bid in each area meeting the requirements of the RFQ, for a total bid price of $1,873,776.06 (net HST included) over three years with funding from Solid Waste Resources Operating Account R322 6399 (as outlined in the Financial Implications section of the staff report dated August 24, 2021) as follows and as outlined in Table 1 of the staff report dated August 24, 2021:

Area A: Halifax/Western County to Green For Life Environmental in the amount of $1,009,657.47 (including net HST)

Motion:
That Halifax Regional Council approve an increase to the contract with Wilcraft Concrete Services (Tender 20-411, PO 2070851071) for additional work added to the original scope in the amount of $10,383.34 (net HST included) with funding from Project Account CM200002 – Ferry Terminal Pontoon Rehab as outlined in the Financial Implications section of the staff report dated August 10, 2021.

That Halifax Regional Council award Tender No. 21-163, Wharf Repairs - Phase 2 – Halifax and Dartmouth to the lowest bidder meeting specifications, Acadian Marine and Diving Ltd. for a Total Price of $1,718,291 (net HST included) with funding from Wharf Recapitalization – CB000087, as outlined in the Financial Implications section of the staff report dated August 23, 2021.

That Halifax Regional Council: 

1. Suspend the rules of procedure under Schedule 2, the Audit and Finance Standing Committee Terms of Reference, of Administrative Order One, the Procedures of the Council Administrative Order, requiring the Standing Committee to review and make recommendations on proposals coming to the Council outside of the annual budget or tender process; 

2. In accordance with the COVID-19 Administrative Order, approve a withdrawal from Q421 General Contingency Reserve in the amount of $780,289 without the Audit and Finance Standing Committee reviewing and making a recommendation on the impact to the Reserve; 

3. Waive the requirement for the Audit and Finance Committee to approve a budget increase of $780,289 to Capital Account No. CM200009 – ‘West Bedford Park and Ride’ with funding from Q421 General Contingency Reserve as outlined in the Financial Implications section of the staff report dated August 24, 2021; 

4. Award Tender 21-256, Transit Park and Ride Phase 2 – Bedford, to the lowest bidder meeting specification, Dexter Construction Company Limited, for a total price of $3,312,032 (net HST included) with funding from CM200009 – West Bedford Park and Ride, as outlined in the Financial Implications section of the staff report dated August 24, 2021; and

5. Approve an increase to the Construction Services component of Consulting Services to Design Point (P.O. No. 2070845674) in the amount of is $7,727.59 (net HST included) with funding from Capital Account No. CM200009 – ‘West Bedford Park and Ride’, as outlined in the Financial Implications section of the staff report dated August 24, 2021.

That Halifax Regional Council:

1. 2. Award Tender No. 21- 003, Request for Tender - Cogswell District Project to the lowest bidder meeting specifications, Dexter Construction Ltd. for a Total Tender Price of $95,663,633.52 (net HST included) with funding from Capital Account No. CT000007- Cogswell Interchange Redevelopment as outlined in the Financial Implications section of the staff report dated September 6, 2021; 

3. Approve an increase to RFP 16-047 (PO# 2070765948) to WSP for design services required to cover additional work to support the extended tender bid period in the amount of $26,665.93 (net HST included) from Capital Account CT000007- Cogswell Interchange Redevelopment as outlined in the Financial Implications Section of the staff report dated September 6, 2021;

4. Approve an increase to Project CT000007 – Cogswell Interchange Redevelopment in the amount of $27,531,946 with funding to be provided by debt financing, as outlined in the Financial Implications Section of the staff report dated September 6, 2021;

5. Give First Reading to proposed By-law S-316, amending By-law S-300, Respecting Streets as set out in Attachment A of the staff report dated September 6, 2021 to mandate the undergrounding of utility infrastructure in the Cogswell District; and  

6. Direct the Chief Administrative Officer to report back to Regional Council with project status updates on a semi-annual basis. 

11.2 ENVIRONMENT AND SUSTAINABILITY STANDING COMMITTEE
11.2.1 Review HRM Litter Receptacle Placement Criteria

Motion:
That Halifax Regional Council direct the Chief Administrative Officer to: 

1. Maintain existing Public Space Litter Receptacle Criteria set out in Attachment A of the staff report dated August 25, 2021 to ensure continued consistency and collaboration across departments and agencies who manage litter in the Municipal right-of-way or public spaces (i.e. right-of-way, parks, sports fields and trails);

2. Increase public awareness of the placement criteria and service standards for litter receptacles as part of ongoing municipal campaigns, including publishing a map identifying the location of receptacles; and

3. Continue purchasing lids for all 45-gallon litter drums to address concerns of blowing litter and animal access.

That Halifax Regional Council:

1. Suspend the Rules of Procedure under section 17 of Administrative Order One, the Procedures of the Council Administrative Order; and

2. Endorse the Plastics Resolution as outlined in Attachment 1 of the Request for Consideration form dated September 2, 2021.

That Halifax Regional Council set a date for a heritage hearing to consider the inclusion of 173 Crichton Avenue, Dartmouth in the Registry of Heritage Property for the Halifax Regional Municipality as shown on Map 1 of the July 20, 2021 staff report, as a municipal heritage property under the Heritage Property Act.

11.3.2 Case H00514 - 2021-2022 Financial Incentives Program for Schmidtville and Old South Suburb Heritage Conservation Districts[PDF]
Motion: 
That Halifax Regional Council approve the proposed grants to the properties listed in Attachment A of the August 6, 2021 staff report, conditional upon the applicant’s compliance with Sections 7 and 36 through 39 of Administrative Order Number 2020-005-ADM, Respecting a Financial Incentives Program for the Schmidtville and Old South Suburb Heritage Conservation Districts, and the requirements specified in Attachment A of the August 6, 2021 staff report being satisfied.

12.1 Councillor Lovelace
Motion:

That Halifax Regional Council request a staff report to fund the NSUARB ordered stormwater right-of-way cost as general tax, since all municipal roads are general rated and paid for by all taxpayers; and, all dwelling and commercial properties in HRM benefit from effectively managed stormwater on municipal roadways, not including properties that are essentially ancillary to a dwelling.

14.1 Ratification from Committee of the Whole September 14, 2021 - Proposed Administrative Order 2021-003-OP, Respecting Amendments to Municipal Design Guidelines - Municipal Design Guidelines (Red Book) Update
Motion:

That Halifax Regional Council:

1. Give first reading and schedule a public hearing to consider the proposed amendments to the Regional Subdivision By-law as set out in Attachment B of the staff report dated June 16, 2021;

2. Request a supplementary staff report regarding the elimination of suburban road standards and the adoption of the regional centre standards for the entire urban service area;

3. Request a supplementary report on:
a.    Basing design speeds on street typologies;
b.    Reducing design speeds for minor and major collectors to 40-50 km/hr; and
c.    Reducing design speeds for local streets 25-40 km/h

4. Request a supplementary staff report on reducing the minimum width of minor collector roadways to seven meters;

5. Request a supplementary report that considers the benefits either requiring two sidewalks on a street or a design as a Residential Shared Street as provided in the NACTO Design Guides for inclusion in the Municipal Design Guidelines (Red Book);

6. Request a supplementary report looking at the benefits of adding raised intersections to the Municipal Design Guidelines; and

7. Request a supplementary report looking at the benefits of adding medians and islands to the Municipal Design Guidelines.
