On February 20, 2024, Harbour East – Marine Drive Community Council adopt the amendments to the Land Use By-laws within its jurisdiction, as set out in revised Attachment A of the staff report dated October 23, 2023.
On February 20, 2024, North West Community Council adopt the amendments to the Land Use By-laws within its jurisdiction, as set out in revised Attachment B of the staff report dated October 23, 2023.
On February 20, 2024, Halifax and West Community Council adopt the amendments to the Land Use By-laws within its jurisdiction, as set out in revised Attachment C of the staff report dated October 23, 2023.

Request

The Municipality proposes to introduce minor amendments to the Interim Density Bonusing  land use regulations outside of the Regional Centre, originally approved under Case 24063. This will require amendments to the following Land Use By-laws (LUBs):
•    Beaver Bank, Hammonds Plains, and Upper Sackville;
•    Bedford;
•    Cole Harbour/Westphal;
•    Dartmouth;
•    Eastern Passage/Cow Bay;
•    Halifax Mainland;
•    North Preston, Lake Major, Lake Loon, Cherry Brook, and East Preston;
•    Sackville;
•    Sackville Drive;
•    Planning District 5 (Chebucto Peninsula); and,
•    Timberlea/Lakeside/Beechville

Proposal

The following key changes is proposed to each of the 11 affected LUBs: 
•    Amend the collection date of the public benefit contribution from prior to receiving the development permit to before the issuing of an occupancy certificate, or as specified in the incentive or bonus zoning agreement.

Similar amendments are being proposed in the Regional Centre Land Use By-law under Case 2023-00462.

Process

The case will be considered under the LUB Amendment process.

The first reading was held by Harbour East-Marine Drive Community Council on January 11, 2024.

The first reading was held by North West Community Council on January 15, 2024.

The first reading was held by Halifax and West Community Council on January 16, 2024.

The joint public hearing was held by Harbour East-Marine Drive Community Council, North West Community Council and Halifax & West Community Council on Tuesday February 20,2024.

THAT the North West Community Council adopt the amendments to the Land Use By-laws within its jurisdiction, as set out in revised Attachment B of the staff report dated October 23, 2023.

TAKE NOTICE THAT Halifax and West Community Council did, on February 20,2024, approve the following application:

THAT the Halifax and West Community Council adopt the amendments to the Land Use By-laws within its jurisdiction, as set out in revised Attachment C of the staff report dated October 23, 2023.

Any aggrieved person, the Provincial Director of Planning, or the Council of any adjoining municipality may, within fourteen days of the publishing of this notice, appeal to the Nova Scotia Utility and Review Board (902-424-4448) in accordance with the provisions of the Halifax Regional Municipality Charter.
