Request

ZZap Consulting Inc. is applying to amend the Halifax Municipal Planning Strategy and Halifax Mainland Land Use By-law. The applicant wishes to construct a mid-rise apartment building at 44, 44B, 46, and 48 Main Avenue, Halifax.

Proposal

The proposal includes changing the zoning of the subject site at 44, 44B, 46, and 48 Main Avenue, Halifax, from R-2P (General Residential) Zone to C-2C (Dutch Village Road Mixed Use) Zone.

The applicant wishes to construct a mid-rise apartment building. The major aspects of the proposal include:
•    70 residential units
•    Underground parking garage with 16 vehicle parking spaces

Regional Council directed staff to consider a reduction in parking requirements and changes to the maximum building dimensions permitted in the C-2C Zone. These changes are requested to accommodate the proposal.

The applicant has provided concept drawings that illustrate how the property could be redeveloped under the C-2C Zone requirements and with the requested changes.

Expanded Study Area: 50A, 50B, 52, 54, 58 Main Avenue, Halifax 

As part of this application, staff identified an expanded study area that includes five additional properties at 50A, 50B, 52, 54, and 58 Main Avenue. Regional Council directed staff to include this expanded study area in the review. These five properties (50 to 58 Main Avenue) are proposed to be rezoned from R-2P (General Residential) Zone and R-2AM (General Residential Conversion) Zone to C-2C (Dutch Village Road Mixed Use) Zone.

The proposed rezoning would permit the existing uses and would allow these properties to be used for any use permitted in the C-2C Zone. Development of these properties would be subject to the requirements of the C-2C Zone of the Halifax Mainland Land Use By-law.

Process

The application will be considered under the MPS Amendment and Land Use By-law Amendment Process.

This planning process has been incorporated in the into the proposed Housing Accelerator Fund (HAF) amendments.  The proposed amendments to the Halifax Municipal Planning Strategy (MPS) and Halifax Mainland Land Use By-law (LUB) are to extend Area D of Plan Dutch Village Road to several properties on Main Avenue, Halifax.  The intent is to apply the Commercial Designation and the C-2C (Dutch Village Road Mixed Use) Zone to several properties; 44, 44B, 46, 48 50A, 50B, 52, 54, and 58 Main Avenue to enable mid-rise residential development.  The proposed amendments also include site specific changes to C-2C Zone standards to provide the reasonable redevelopment of the lands while taking into consideration the irregularity of the site in both slope and lot depth, ensuring compatibility of the proposed building with the abutting residential development form, and ensuring major commercial activity is located along Dutch Village Road.
